All of the most recent protests in Ferguson over the slaying of Michael Brown seem recent since the protestors have all asked for the same thing: That is to slap the cuffs on Darren Wilson, the officer who gunned down Brown on August 9. The reasons given for Wilson's freedom by some are that the prosecutors and cops almost never arrest and charge other cops with misconduct, the St. Louis County Prosecutor is a bigot, and there's no smoking gun piece of evidence to base an arrest on.
These are all powerful blocks to clamping the cuffs on Wilson. But they aren't the prime reasons. The single biggest barrier to arrest and prosecuting police officers in the use of deadly force in the shootings of unarmed civilians -- even those who have committed no crimes or are even suspected of crimes at the time of the shooting, as is the case with Brown -- is the ancient self-shielding uttered by the officer of the magic words, "I feared for my life or the life of others."
These words are codified in law in many states. Missouri is one of them. It's called the Missouri Defense of Justification Statute. It flatly says that an officer can use deadly force when "he or she reasonably believes" it's necessary to protect life. The operative words are "reasonably believes." Translated, that means that there is no written code, rule, or guideline for what exactly reasonable belief is or means. It's purely a judgment call by the officer at the moment he or she draws his or her pistol and opens fire....

I’m sure some bigoted thug is going to try and assassinate Wilson well before the jury hands down its verdict. While such a situation would be unfortunate, it may also bring revelation to the media-watching sheeple when the media will inevitably try to defend the thug.
Means nothing to Libs. It’s all about feelings. The law is only a factor when it supports their position. At any time when it does not, it is not even a consideration.
Wilson only shot 50% of the guys that assaulted him that day. Doesn’t that demonstrate restraint?
How on earth would you "codify" all possible contingencies where the officer or someone else might be threatened? There are many, many situations in the law where "reasonable belief" (ie. common sense) has to be the determining factor.
What justifies the shooting is that the savage gorilla entered and attacked the officer in his car, beat his face and head, tried to take his gun - making the gun go off. And then, after this moron managed get about 30’ away in his attempt to escape, he turned around and bum-rushed the officer in yet another aggressive attack. Brown was no longer trying to escape, I believe his actions demonstrate that this lowlife had every intention of killing the officer. That officer had every reason to be in fear of his life.
If it were me and if I had the power, I would have brought this puke back to life and then killed him all over again. I might have done that again and again until it was time for lunch and then I would have ordered a piece of fresh apple pie.
I am so sick and tired of all Obama’s friends, son’s, etc.
Hutchinson is a racist.
Darren Wilson is a national hero. They had better not touch him!!.
Evidence?
Why would any evidence be require?
The White Hut community organizer needs a white boogey man.
It is RACIST to deny him one.
Surprise, surprise...
"He is a frequent MSNBC contributor."
He violated the right to assault whitey
If there was sufficient evidence to indict Wilson, he’d be indicted already.
That they haven’t indicted means they’re fishing for a case where there isn’t one.
Ferguson is being orchestrated straight out of the opium den annex of the Oral Orifice.
Its Huff-n-puff.
The rioting crowd was there for the free booze, Air Jordans and big screens. Facts were not an important ingredient.
Evidence is no longer required in the USA; the American people don’t want it. “Justice” is based on their foolish wishes.
I must be losing my command of English word usage and sentence structure, because this is writing that would not get B’s in 5th grade English.
In the world of the perpetually aggrieved, they always see plots by whites behind everything. Right now, “whitey” is disrespecting them by not lynching officer Darren Wilson so they can appease their racist blood lust. Besides it isn’t fair and it “proves” how racist whites in control have manipulated the law against blacks. Horse hockey to you race baiters. I guess you’ll just have to show everyone you displeasure by rioting, pillaging, looting, and arson to get “respect”, right?
Of course, whether the belief is reasonable would ultimately be up to the jury. It doesn’t seem to me that the Missouri statute permits the officer to decide for himself what is reasonable.
In post-constitutional America, the law is whatever we want it to be.
National heroes aren’t very admired in the USA.
