A Volusia County sheriffs deputy shot and killed a Port Orange man who was brandishing a firearm Saturday in Daytona Beach, Sheriff Ben Johnson said.
Edward P. Miller, 52, died at the scene after being shot by Deputy Joel Hernandez at about 2:30 p.m.
Hernandez and another deputy who has not been identified already were at Fryers Towing on an unrelated matter when one of them heard a heated argument taking place outside, sheriffs spokesman Gary Davidson said.
Hernandez went to investigate, and after identifying himself as a deputy, he noticed Miller was armed with a gun, Davidson said.
While the specific sequence of events isnt being released at this time due to the ongoing investigation, during the encounter, Hernandez perceived a threat and fired his duty weapon, striking and killing the man, Davidson said.

If this was a nut who was threatening bystanders for no good reason with his gun, it’s understandable he got what he got. Still it’s sad that a taser, etc. which is intended for situations like this, was not available. Drunken brawler?

One article said Miller “brandished” a gun, this article says the officer “noticed” Miller was armed. BIG difference.
I doubt that a taser is a good weapon to use against a man with a gun.
A taser would be appropriate when dealing with a really violent bare handed fighter who could overwhelm the cop if not stopped.

That tow yard is an impound lot ,, article states they father/son attempted to get the car out on Friday and returned Saturday... we need facts but I’d bet the incestuous relationships between the police and tow/impound companies ... especially as Daytona is a very poor area .. lead to overcharging and escalated tensions.
Contracts with the PD that allow you to rape citizens are not bueno.
These Tow in lots pay a fortune for the contract with police agencies. The Police allow the companies to rape those people because the PD makes so much money on the contract. The Police make it very difficult to get the car out of the impound lot, meantime the charges mount up and up each day as much as $100 per day.
