A Blair County man to be executed for three first-degree murder convictions asked a federal judge on Monday to stay his execution by Pennsylvania while he appeals his sentences.
Miguel Padilla, 34, of Gallitzin plans a federal challenge of the constitutionality of his convictions and sentence, said the brief filed by Marshall Dayan, an assistant federal public defender who specializes in death penalty appeals.
He's also asking for the court to appoint an attorney to handle his final appeal and waive his filing fees. Gov. Tom Corbett on Monday signed the death certificate for Padilla.
Padilla's state appeals ran out in June when the Supreme Court refused to hear his challenge of lower court decisions upholding his convictions.
A Blair County jury in 2006 convicted the construction worker of killing three people at an Altoona social club after his friend was denied admittance. Padilla fatally shot Alfred Mignogna, 61, owner of the United Veterans Association Club; Fredrick Rickabaugh Sr., 59, the club doorman; and Stephen M. Heiss, 28, a club patron.

He was convicted in 2006. IMHO he should have been plant food by now.
That’s the trouble with Pennsylvania. There is a death penalty, but with a slew of appeals, the condemned can live to a ripe old age and die from natural causes. And of course, prisoners get good medical care, paid for by the taxpayers
There should only be so many appeals and the process should be completed in a month. Then if unsuccessful, the convicted should get the needle.

As I read the original article, the Mexican Government made an appeal to the SCOTUS and was denied. Isn’t it wonderful, this POS has been here since he was 9 and yet somehow he feels entitled to status as both a Mexican and a US Citizen. Hope the judge says Adios MF, and let’s the State kill him.

I remember this case, and lived near where it happened .. Still stunned he made it all the way through High School, entered job market (?) .. but ILLEGAL .. The area he was, is relatively small community ... commits murder at private club, and under NO circumstances does he deserve anything short of DEATH !!!!

That is exactly what has been happening. The ones they send across the border don’t look like the first family of Mexico.
I’ve been to places in Mexico and they look nothing like the Mexicans the racist leaders send our way. The ones I’ve met there are educated and have a high standard of living. These aren’t the ones they’re sending our way.

Anybody read a story last week of a Canadian guy who was jailed and fined $5000 for entering the country illegally? I wish I would have saved that, of course the press will bury that but I read it on one website. That is EXACTLY what needs to happen. $5000 buck fine minimum, jail and then deportation and if they can’t pay that fine then they don’t get back in legally and if they enter again illegally then you add on another $5000. Just think of all the things you get fined for today, parking tickets, traffic tickets, regulation fines, practically anything where you break the law they use as an excuse to clean you out....all except invading the country. In fact the opposite is true, they PAY them.
