District attorney drops charges against activists who blocked coal freighter, says they were right

FALL RIVER, Mass. – In May 2013, two environmental activists piloted a lobster boat close to the vast pile of coal at the Brayton Point Power Station, the hulking plant that overlooks this industrial inlet near the border between Massachusetts and Rhode Island.

With the tiny boat, the two men – Jay O’Hara, 32, and Ken Ward, 57 – dropped anchor and for a day blocked a freighter with a 40,000-ton shipment of coal, and they were arrested and charged with conspiracy, disturbing the peace and other violations.

The two were scheduled to be tried on Monday, and they planned to deploy an old legal argument called the necessity defence: They had no choice but to act because the consequences of climate change are so dire. But instead of a jury trial, the major charges were dropped or downgraded by the district attorney, who said, in effect, that he was sympathetic to the defendants’ point of view on climate change.

This winter when it is ten degrees outside and the coal fired power plants on the east coast shut down because they don’t have any coal to burn and the power goes off in his neighborhood I wonder how grave a crises Global Warming will be in this idiot’s mind.

Shut down New England coal fired generating plants, and stop delivery of home heating oil. Enjoy a green winter.

There is a crisis of corrupt lawless DAs who need to be removed from office by whatever means needed. Does the DA have a problem with someone removing the threat he poses?

My theoretical best-ever federal natural resources law - If a state is not doing all it can to encourage the extraction of conventional energy sources from within its borders or off its shores, they would be denied any energy (coal, oil, electricity) produced in another state. Likewise, if you interfere with the use of conventional energy sources by other states, or transfer of said resources to another state, your state boundaries just become embargo points for every other kind of commerce you would like to transact with another state.

You want to be exclusively green despite having an abundance of potential energy underfoot? Be my guest. That's what federalism is all about - 50 separate experiments, based on what the people of the state want. Or, as the Left would say, karma is karma.

A DA who is “sympathetic to the defendants” has no business on the case. He should have recused himself. Given his lack of professionalism he should be thrown out of office.

We had no choice, Your Honor. Illegal aliens with infectious diseases, cartel members trafficking drugs and humans, and Islamic terrorists bent on our destruction were streaming over the U.S.-Mexico border into our communities. It was a necessity to block that border! We’re not guilty.

Yeah, that’ll work for us. /s
