MS judge throws out Chris McDaniel's lawsuit against election result, says he missed deadline

A Mississippi judge on Friday dismissed Tea Party-backed Senate candidate Chris McDaniel's lawsuit, in which McDaniel has been attempting to overturn his narrow defeat in the Republican primary against incumbent Sen. Thad Cochran — on the grounds that McDaniel missed the deadline to even file his challenge.

Judge Hollis McGehee agreed with the Cochran campaign's contention that under a 1959 state Supreme Court ruling, there is a 20-day deadline to file an election challenge. By contrast, McDaniel filed his challenge 41 days after after the June 24 Republican primary runoff, which Cochran won by about 7,000 votes.

McDaniel's lawyer told the Jackson Clarion-Ledger that McDaniel wants to decide over the weekend whether he will appeal McGehee's ruling up to the state Supreme Court; McDaniel will announce his decision on Tuesday.

McDaniel previously requested that the state Republican Party executive committee simply declare him the winner by about 25,000 votes, which the state GOP chairman declined to grant. McDaniel has been defiantly seeking to overturn the primary result, ever since the election night. Among other things, he has charged that Cochran's campaign strategy — which involved reaching out to the (usually Democratic) African-American community to cross over into the Republican primary — had fraudulently overturned the will of genuine Republican voters.

Well, not really. There are other races (local) that I really want to vote on. I will leave the senate race blank though. I can’t vote for someone who told me I’m KKK because I think 17T in debt is unsustainable.

Mark Levin opened his show talking about the Cochran/McDaniel election last night, saying that after what happened in this race he wouldn’t vote for Thad Cochran because he’d be betraying himself to do so:

“If I lived in Mississippi, I would not vote for Thad Cochran, because Thad Cochran has besmirched me.

Thad Cochran has told Democrats, minorities, liberals, anybody who would listen that I’m a racist and that I want to stop black people from voting.

People assigned to him, people associated with him — Cochran hasn’t denounced any of this. Mitch McConnell hasn’t denounced any of this. John McCain hasn’t denounced any of this. Haley Barbour hasn’t denounced any of this.

They’re having a party! They won!

They won, and why? They’re so desperate to keep a constitutional conservative out of the Senate? They’re so desperate to protect a man in the early stages of dementia, because he’ll vote the way they want him to vote, because they can control him?

Travis Childers has my vote in November. And yes I am doing it out of spite to Cochran and the Barbours.

Why didn't his attorneys know about this ruling?

Sounds to me they did it on purpose. Appease the establishment while keeping the Tea Party ginned up. I wonder what he was promised by the GOPe... keep a watch.

I believe we have obstruction of justice here and that brings into effect the Voting Rights Act which was passed after the State law the “Judge” used to throw out McDaniel’s case.

I don’t trust any of them.

It’s not like there’s not massive vote fraud on a state level. Probably local too. I can’t get enthused when I’m pretty sure my vote doesn’t count.

returns in the double digits in the third party is the only way to teach these sons of bitches a lesson..

any other vote is a vote for communismn...

I've been saying this from the start.

First they will tell him that he has to wait. Then they will tell him that he should have filed sooner.

I'm not sure of anything anymore.

I seem to recall during the Coleman / Franken race, there were things that Coleman was told had to wait until the court challenge, and then in the court challenge he was told there were things that should have been done before certifying.

I think they all make it up as they go, deciding whatever best suits their needs at the time. That's why McDaniel needs to be very sure that he's doing everything possible now before the run-off is certified, including verifying what is no longer possible after certifying, and if possible to delay certification if he's being denied access to documents that he needs to see now.

Hard drives have a way of crashing between now and a court hearing, and ballots are going to start being printed.

First, they tell you that you have to wait until after certification. Then after certification they tell you it's too late, you should have done it sooner.

They all know that this was a bad election. If honest elections really were what the courts want, they wouldn't hide behind a loose technicality like this. They would claim that the public interest outweighed a legislative artifact like this date, and the trickery that delayed McDaniel.

Any decent attorney would have early on looked up the law as to the deadline for filing and other pertinent information and rules.

So one must ask whether the attorney is competent or whether something else is going on.

It is already obvious that politics in that state is dirty, corrupt, etc....

So which is it? Stupidity or something worse?

Speaking of New Jersey, the NJ court had no trouble at all bypassing deadlines when they let Democrats swap Frank Lautenberg for Robert Torricelli.

Deadlines are for Republicans only.

I already got an email from mcdaniels tda askg for $ to fund a runoff between him Cochran.

Won’t there just be more MS blacks crossing over in any runoff too?
