Indictments have consequences.
Democrats are still smiling over the recent felony indictment of Rick Perry, even as the Governor’s legal team is taking steps in court to reveal the spurious nature of the charges.
One consequence of the indictment, however, has thrown conservatives in Texas for a loop.
Texas media began reporting last week that because of the charges against him, Governor Perry’s concealed carry license has been suspended by operation of law.
§411.187 of the Texas Government Code states that the Department of Public Safety shall suspend (not revoke, as it has been reported) a concealed carry license if the license holder is charged with the commission of a felony under an information or indictment. The same section of the statute states in part that if the suspension is due to a felony indictment, that the Department shall suspend the license until dismissal of the charges.
While the actual suspension of Governor Perry’s concealed carry license isn’t malicious — you can tell it’s a statutory directive by the use of the word “shall” — it’s sure to pose an inconvenience to a man who has defined himself as a champion of gun rights. According to Reuters, the indictment also limits Governor Perry’s Second Amendment rights in other ways:
Under federal law, he is prohibited from buying guns and ammunition while under indictment for a crime punishable by imprisonment for a term exceeding one year.
“What he has he can use, but he can no longer purchase new stuff because of this felony charge,” said Josh Felker, who runs Lone Star Handgun, a shooting range near San Antonio.
Fortunately, the Governor will not be forced to surrender any guns or ammunition currently in his possession, and is still permitted to carry handguns on property that he “owns or controls.” He won’t be left defenseless, either: the ability of his security detail to carry concealed hasn’t been affected by the indictment.
This is the rank equivalent of a Stalinist purge! After this is resolved by the Texas high court, Perry needs to go after the Rats and Repukes who were involved with this, and throw them in jail!!!!
The bitch ought to be prosecuted for abusing her office.
File felony charges to all involved for conspiracy to violate Rick’s civil rights. There is a real case there.
So... guilty (punish) until proven innocent?
damn
Can he pardon himself? (just wondering)
Governor you have had more than enough time in office, you could have fixed this type of gov’t overreach.
How many innocent Texans have suffered this very same injustice, now it’s your turn in the barrel, I have no sympathy for you.
She certainly looks/acts like the typical progressive loser in office. They are all the same.
They’re suspending his 2nd Amendment rights? Whaaaaat? Free men don’t ask permission.
I think the paper understates the effect of THE FEDERAL LAW !
Let us hope he challenges the Federal law.
‘It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person (1) is under indictment for, or has been convicted in any court of, a crime punishable by imprisonment for a term exceeding one year; (2) is a fugitive from justice; (3) is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802)); (4) has been adjudicated as a mental defective or has been committed to any mental institution; (5) who, being an alien (A) is illegally or unlawfully in the United States; or (B) except as provided in subsection (y)(2), has been admitted to the United States under a nonimmigrant visa (as that term is defined in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(26))); (6) who [2] has been discharged from the Armed Forces under dishonorable conditions; (7) who, having been a citizen of the United States, has renounced his citizenship; (8) is subject to a court order that restrains such person from harassing, stalking, or threatening an intimate partner of such person or child of such intimate partner or person, or engaging in other conduct that would place an intimate partner in reasonable fear of bodily injury to the partner or child, except that this paragraph shall only apply to a court order that (A) was issued after a hearing of which such person received actual notice, and at which such person had the opportunity to participate; and (B) (i) includes a finding that such person represents a credible threat to the physical safety of such intimate partner or child; or (ii) by its terms explicitly prohibits the use, attempted use, or threatened use of physical force against such intimate partner or child that would reasonably be expected to cause bodily injury; or (9) has been convicted in any court of a misdemeanor crime of domestic violence.
Exceptions as quoted from 18 U.S.C. 921 (a)(33)(B):
(ii) A person shall not be considered to have been convicted of such an offense for purposes of this chapter if the conviction has been expunged or set aside, or is an offense for which the person has been pardoned or has had civil rights restored (if the law of the applicable jurisdiction provides for the loss of civil rights under such an offense) unless the pardon, expungement, or restoration of civil rights expressly provides that the person may not ship, transport, possess, or receive firearms.’
So his “carry” permit was yanked...he should open carry.

If Rick Perry is sincerely eyeing a possible presidential run in 2016, hes getting off to a bad start.
Prominent conservatives like Mark Levin along with countless individuals within the grassroots movement are questioning his judgment after it was announced that failed-former McCain Advisor (and full time MSNBC contributor/Palin-basher), Steve Schmidt was joining his legal team. Further, Henry Barbour, who recently betrayed Mississippi conservatives in encouraging Thad Cochran to campaign like a race-card playing liberal, has also been added to the team.
PJ Medias Bryan Preston remarks: (emphasis mine)
Schmidt is best known among the conservative grassroots for bashing former Alaska Gov. Sarah Palin years after her and Sen. John McCains failed run for the presidency in 2008. Both Schmidt and Nicole Wallace were 2008 McCain campaign advisers whose bashing of Palin and other conservatives in the years since has made them unpopular figures among Tea Party supporters and the GOP grassroots.
[...]
Both seem happy to resurrect problems from that campaign and blame them on others, either Palin or conservatives, not themselves for running a terrible, flaky, indecisive, and ultimately unsuccessful campaign.
[...]
Henry Barbour is known for a more recent transgression, smearing conservatives during the controversial Mississippi primary battle between Sen. Thad Cochran and state Sen. Chris McDaniel.
Popular Breitbart writer, Tony Lee weighed in yesterday stating that Perry has "aligned himself with two of the most infamous Republican establishment operatives known for trashing conservatives." Lee goes on to say:
Perry is working with Henry Barbour, whom conservatives want the Republican National Committee to censure for his groups smearing of conservatives in the Mississippi Senate runoff, and Steve Schmidt, who has elevated his profile by maligning conservatives, especially former Alaska Governor Sarah Palin.
[...]
Perry should be aware of scorpions like Messrs. Barbour and Schmidt, especially if he has dirty laundry. And even if he doesnt, he should be no less worried, because those like Schmidt have proven that they may just make things up if things sour.
If you notice, Lee links to a classic Breitbart article written by our very own Stacy Drake that dissects and breaks down the "Game Change" flop.
And of course, conservative icon, Mark Levin remarked via Facebook:
Why would Perry hire this conservative-attacker and Palin-hater?
Indeed.
It doesnt make sense for Perry to pal around with establishment thugs whose claims to fame lately have been trashing conservatives who are popular with the grassroots and using liberal tactics to do it. Texans love Governor Palin, especially Texas Republicans just as Mississippi Republicans loved (and voted for) Chris McDaniel.
Governor Palin recently came to Governor Perrys defense over this indictment and she also endorsed his run for re-election in 2010.
In her defense of Perry recently though she did say (with her usual prescience):
Rick wont have to worry about the Republican establishment piling on, either. Hes more ingratiated with the political machine than someone considered still an unknown whod go rogue on GOP kingmakers when they acted unethically, so hes fortunate to only face a firing squad from one side.
Apparently he doesnt have anything to worry about where the establishment is concerned. But not having to endure a pile-on is much different than a deliberate association with individuals who have stabbed many of your supporters and friends in the back.
The effect of the grassroots continues to grow. While most in the media foolishly measure the growth of the grassroots by election wins and losses alone, they ignore what establishment Republicans like Henry Barbour have to go through to win, things like race mongering, cheap and dirty tactics, and people like Steve Schmidt who care more about packing their own parachutes than they are at honoring the values of their party and by extension, their country. And all that doesnt even include the countless millions and millions they have to spend.
As Governor Palin stated in the past though,"we delight" in their ongoing insistence to underestimate us. With every election cycle, establishment Republicans continue to be lured further out of their ratholes. By 2016, theres no telling just how further empowered the grassroots will be in their honorable mission of resisting the imposters within the national GOP establishment.
As such, Governor Perry not only has created his own possibilities of being sold down the river by Steve Schmidt, hes also putting his credibility with the grassroots on the chopping block for 2016.
What is he thinking?
Once this indictment against Perry is thrown out for a variety of constitutional reasons, Special Prosecutor McCrum and his Demonicrat supporters in Austin need to have a long-term, in-depth, high-definition, panoramic, judicial colonoscopy performed on them during their trial for malicious prosecution and disbarment proceedings.
He can’t pardon anyone without permission from a board. It’s a long process.
/johnny
That old drunk democrat should be in jail before she kills someone..I think all of this will come home to these filthy fools like her..Filth like her should be taken out of the population one day she will slip up and be sent to jail where she belongs.
Possibly: "keep your friends close and your enemies closer".
She ought to be prosecuted for abuse of a camera.
I’m wondering about that. “When they came for the (generals)...”
Are republican governors next?
