EXACTLY. That is a breach right there - subject to civil and criminal penalties, plus sanctions/fines.

The patient or a judge can let that out, not the Provider.

You know, that is a great idea. Laws have very stiff penalties for disclosing protected health information. The cop should sue the living daylights out of CNN and that hosebag reporter.
