Grand jurors deny politics played role in Perry indictment

AUSTIN – Several members of the grand jury that indicted Gov. Rick Perry said Tuesday that his claim the indictment was based more on politics than substance is unfair and disrespectful to the months of work they put in.

The jury, which met weekly for four months, "really tried to keep an open mind and come to a fair decision given all the testimony that we heard," said Janna Bessin, one of the 12 Travis County residents appointed to serve on the grand jury.

"It's too bad," Bessin said, calling the criticism unfair. "But I guess that his side's job – to really spin it.".............

An honest judge would throw out the indictment based upon gross jury misconduct.

If I recall, grand juries only hear the evidence presented by the prosecutor who is appearing in front of them for the explicit purpose of getting an indictment.

The defendant does not have an opportunity to provide evidence or tell his side of the story at that time.

One of the resident legal minds here at FR could no doubt give some better insight on the issue.

This is such a weird situation, the whole Travis County Public Integrity unit thing. From what I've been able to learn, apparently, in 1982, the Democrat Travis County DA just created the unit, and assumed for himself the power to investigate state officials and offices. The 'Rat governor at the time naturally approved it, which seems to me to be the real abuse of power. Since then, the unit has been dedicated almost exclusively (so it seems to this outsider) to bringing charges against Republican state officials and Republican-led state agencies.

The upshot is that, given that Travis Co./Austin is so overwhelmingly Democrat/Communist/Leftist/friggin' weird, having the DA there with the authority to investigate and bring charges against state officials, who are largely Republican, and department heads, also largely Republican, it's the tyranny of the minority.

Tom DeLay said on Fox News this morning that the unit is unConstitutional, which it seems to me it is. After all, why would a DA, elected locally, have the power to investigate and bring charges against officials elected by voters statewide? Why would a local official have the authority to just assume statewide power with no legislation to back it up?

Texan FReepers, do I have the background story right? Is this something that's common knowledge outside the state of Texas, and I'm just now waking up to it? If so, that's freakin' strange. I think if I were a Texan, I'd be fighting it with every fiber of my being, also!

This indictment is a genuine gift of God for Perry, kick starts his campaign if he chooses to try again. Presuming he prevails against this idiocy (a good presumption), it will help position him well.

The 'Integrity Unit' wasn't common knowledge as far as I knew or have heard anyone mention.

There's a push to get it put under the Attorney General where it belongs, but if it has no Constitutional basis to begin with, I'd rather it didn't exist at all.

You pretty much nailed it.

It’s certainly possible for a grand jury to be used for political purposes to achieve a political outcome and the members not realizing or believe it.

It all depends on how selective the DA is in presenting evidence. I’m guessing here that the DA was highly selective in both evidence presented AND interpretation of the law presented.

You left out one of the main things. The state govt funded PIU. The state lege, which has been controlled by GOPers for a long time, appropriated the money.

Then Perry used his line item veto power to veto the funding for PIU. But that was only after Lehmberg refused to resign. If she had resigned, Perry would have left the funding intact. And if she had resigned, then Perry would have had the authority to replace her with someone of his choice, no doubt a republican. So you would have the governor actually controlling the DA's office in Travis county.

Also, you might want to do some research on the history of who all the PIU has prosecuted thru the years. Your statement that it has been only republicans is not correct.

Wouldn’t this permit the indictment to be thrown out on technical reasons?

She may have been ok’d to speak out. The public isn’t reacting to this as expected, and having it tossed on a technicality leaves the cloud of corruption hanging over Perry’s head while denying him the abililty to have it quashed in court, by the perceived legitimacy of a jury.

I'll do further research, then. I want to grasp, as much as an outsider can, what's going on there...because I may be making Texas my home in the not-too-distant future.

I totally left out the funding part, you're right, but that begs another question...why has the Republican legislature continued to fund this apparently un-Constitutional usurpation of state authority? Maybe that speaks to why Jorge Bush was so willing to sign un-(US)Constitutional bills like the creation of DHS, NCLB and the Mediscare drug benefit...he'd done it as the Texan governor in the case of the "Public Integrity" Unit.
