Bail was set at $150,000 for the release of Curtis Reeves, 71, accused of second-degree murder in the shooting death of Chad Oulson, 43

Appeals court ruled that a district judge may have made an error by failing to set bail for Reeves

Reeves shot and killed Oulson at a movie theater in January after a dispute over text messaging

The former police captain must stay home, wear an ankle monitor, surrender his guns and avoid contact with victim's widow

'We are flooded, we are devastated,' said lawyer representing Nicole Oulson after news of Reeves' impending release

Reeves clearly was ready to escalate the confrontation before the popcorn was thrown. There was a back and forth exchange between the two. Witnesses heard them arguing.

Watch bond hearing, Sheriff’s deputy testimony at 58:00 minutes in:

 https://www.youtube.com/watch?v=O5iw1xtJx58&feature=youtube_gdata_player

“That will teach you to throw popcorn at me.” 3 witnesses heard Reeves say that.
According to the sheriff’s deputy who confiscated Reeves’ gun, he heard his wife say: (rough quote) “That was no reason to shoot someone.”

Reeves then told his wife to: “ Shut your fu#king mouth, and don’t say another word.”, according to the sheriff deputy.

When his own wife said (in front of witnesses) the shooting was wrong, why would anyone else defend it? -That is puzzling.

Self-absorbed, easily offended twits demanding the world revolve around them are deeply offended when their selfish behavior is called out. . ..Thank you. Get Off your GD CELL PHONE. You could be my friend.

Let me understand you... you believe that silent texting justifies a self-defense execution?

Reeves ignored the safety of others in the theater and injured Oulson’s wife.
That alone would be considered “reckless endangering” and assault with a deadly weapon, if any common serf were to have engaged in this cowardly act.

where habits reside in the brain and why they are not under conscious control.

"My habits made me do it"? Sorry, nuh-uh.

It might make the lawyers hurry up a little and go with the truth instead of shredding it into microscopic layers

Same can be said about prosecutors with thin cases.

Either we believe in Constitutional protections, or we're no different than Libs and activist judges and their "living document"doctrine, which is how we've arrived at the point we're at regarding other lost liberties.

Something Ol' Ben said about safety and liberty comes to mind, also.

...seven years as a cop...

That explains your inability to assess the situation.

The important fact is the old fart RETURNED to the exact spot after going to his car. That shows his intent to resume the confrontation. That makes it premeditated murder. Just because you don’t like someone’s behavior doesn’t give you the right to force a change or kill them.

The bad guy is alive and home.

He had the gun in his hand the whole time trying to create an incident where he could shoot him. To me that’s premeditation.

This pretty well sums up what I said way back then, and still my opinion today, especially my last line:

“Kind a conundrum isn’t it? It probably was, in fact, the most import text he will ever have sent her.

Of course, if he hadn’t sent it, she could still be waiting for that most important text.

Hopefully he died doing what he loved.”

I don’t like textng or throwing popcorn, that’s why.

The texter should have stopped, moved, or otherwise kept to himself. If he status of his daughter was that important he should have stepped out into the walkway.

After shooting someone, making comments may or may not reveal true intent. Defending yourself or anticipating a problem can be a reflex.

Watch in the video where he kicks the back of his seat obviously trying to provoke him — about 8 seconds before he shoots him.

...throws popcorn at you, perhaps in an attempt to blind you temporarily to aid in their attack?

Only if you are a complete pussy. Are you?

The best thing to do is you are armed and someone is being rude with a cell phone is take the phone from his hand, throw it on the floor and stomp it. Then pull out your gun and say “I hope you’re not too upset.”

You left out the attack by Oulson. FWIW, never throw popcorn into someone’s face that has just returned to a dark theater, whose eyesight had probably not adjusted to the dark and who had been through years of training to respond to a threat.

What kind of training teaches that popcorn is a threat that needs to be met with deadly force? Pity that Oulson hadn't been blind. Then Reeves could had shot his dog, too.

I do believe you may be wrong.

Yes, Reeves is damned lucky to have survived all that popcorn flying around. Perfect justification for shooting someone.

“After shooting someone, making comments may or may not reveal true intent. Defending yourself or anticipating a problem can be a reflex.”

“That will teach you to throw popcorn at me.” 3 witnesses heard Reeves say that.
-those were the words of Reeves *after* he shot Oulson and his wife.
His wife also reprimanded Reeves after the shooting.

Watch the deputy sheriff's testimony in my post #61 to you, before commenting back, otherwise you're just spouting uninformed nonsense.

I believe if you assault some one, you might try again, and then it is battery.

Read the book referenced in the article. There are lessons in the incident for all of us. Pigeonholing it as “bad” cop and ignoring the details is missing something that isn’t common knowledge.

Do the world a favor — stay at home and out of movie theatres and other public places.
