President Barack Obama will nominate Sharon Block to the National Labor Relations Board, the White House said, potentially reigniting a fight with Republicans over the panels composition. Block, a former deputy secretary at the Labor Department and aide to the late Democratic Senator Edward Kennedy of Massachusetts, previously was nominated by Obama to serve on the board, a federal body that adjudicates disputes between companies and employees. Block drew opposition from Republicans, leading Obama to appoint her to the board in January 2012 under a provision of the U.S. Constitution that permits temporary appointments to be made when the Senate is out of session.

the NLRB enacted a rule allowing for ambush elections which rush the collective bargaining process so significantly that workers cannot carefully consider arguments from both the business owner and labor organizer, while employers are severely restricted in their ability to provide information to their own workers. The Obama Labor Board also issued a decision which authorized the formation of micro-unions or small collective bargaining units made up of employees within one place of work. The decision only serves one discernible purpose: allow labor bosses to gain a foothold into workplaces they would not otherwise be able to as the majority of workers oppose the formation of a union.
Ms. Block, who left the board last summer to rejoin the Labor Department as a senior counselor to the labor secretary, was on the board for 18 months,
The backlash to Ms. Block’s nomination began shortly after the White House announced the news. Patrick Semmens, vice president of the anti-union National Right to Work Foundation, said Friday that Ms. Block is a “unionism radical” and called President Obama’s decision to nominate her “an insult to our Constitutional form of government.”
“Instead of being considered to serve on the NLRB, Block should be made to pay back the money she collected at taxpayer expense while illegally serving in violation of the Constitution,” said Mr. Semmens, referring to Ms. Block’s salary.

Sharon Block worked as a senior staffer for Sen. Ted Kennedy (D- MA) on the Senate Health, Education, Labor, and Pensions Committee. During her time on the committee, Democrats spent much of their time unsuccessfully trying to pass card-check legislation. During her previous tenure at the NLRB, she defended the boards decision to award backpay to an illegal immigrant. The Supreme Court reversed the boards decision.
In another case, she sought to force a trash collection company to recognize a union after an election marred by the NLRBs negligence and union misconduct. A federal appeals court rejected the NLRBs petition for enforcement. An NLRB official had overslept and failed to oversee the planned unionization election. The board then arbitrarily rescheduled the election without consulting anyone. The company alleged that some employees switched their votes because they thought that management had caused the delay. Furthermore, it was alleged that a union organizer had promised that those who voted for the union would have their $300 union initiation fees waived. The NLRB refused to even hold a hearing to examine the companys objections to certifying the union.
