A Mexican federal judge sent Andrew Tahmooressi back to prison after the U.S. Marine sergeant made his first official courtroom appearance since being locked up more than three months ago for accidentally crossing the border with guns in his pickup truck.
The 26-year-old veteran of two tours in Afghanistan was finally able to tell his story to a judge, after his case had been delayed by both Mexico's unpredictable legal system and his own trouble settling on a lawyer. It was not immediately clear what Tahmooressi said at the evidentiary hearing, which was closed to the public. The next hearing in the case is scheduled for August 4.
Despite the judge's ruling, Tahmooressi's attorney, Fernando Benitez, told reporters that he was confident that the Marine's case was on the right track. Benitez said that his client's statement to the judge was "sound and made perfect sense," and claimed that irregularities with Tahmooressi's detention were grounds for dismissal of the case. The attorney said that his client was not provided with consular services for nearly eight hours after he was detained, nor did he have access to an adequate translator.
In addition, Benitez said that the order to search Tahmooressi's vehicle was dated March 28, three days before the Marine crossed the border.
Benitez had earlier sought to dampen hopes that federal Judge Victor Octavio Luna Escobedo would free Tahmooressi, although supporters, including his mother, Jill Tahmooressi, had held out hope.
Tahmooressi has been held since March 31, when he accidentally drove into Mexico at the San Ysidro, Calif., Port of Entry late March 31, after becoming disoriented from poorly lit street signs and being in a position on the road unable to make a last ditch U-turn.

That's where his family messed up. They didn't understand the Mexican justice system. They failed to grease the proper hands hence the trial. Now it's too late to pay to get him out, too much publicity.

If Blam won’t secure the border he sure won’t bother to get one crummy marine out of a Mexican Hellhole. Its maddening but nothing will be done.
Mexico has declared war on America many year ago. It is now just with illegals being placed all around America and the border attacks. Time to declare war on Mexico and wipe out this rat hole in about a week.

We could have our marine back in a week IF the Commanding Officer at Camp Pendleton had a pair of balls. All it would take is for him to put Tijuana off limits. The economic impact would cripple the cesspool of a town.
It’s a disgrace that he didn’t do that the day he found out a marine was kidnapped by the corrupt Mexican government.

We need to smuggle in some papers showing that this Marine is a teenage MS-13 member from Central America. The Mexicans will return his weapons and transport him to the border, and then Obama will give him free transportation and housing anywhere he wants to go in the USA.

I submit it is not a matter of having balls.
First, the CO may have received direct orders from the Pentagon to not declare TJ off limits. Secondly, there is the sticky question of whether this Marine is guilty of trafficking arms. With regard to the latter, the CO is no doubt better informed than you and I via military intelligence (we do have friends in strange places).

That was inserted specifically to deal with the Vietnam atrocities inflicted on our men and our men being broken. Until then, no allowances were made for breaking a man and many of the POWs when broke, never could shed their deepest feelings of shame for violating the Code, and some died in captivity rather than being ‘broke.’

Mexican attorneys are known extortionists when representing Americans in their prisons...........and it's apparent this Marine and his family are going to be taken for every American dollar they have.
What kind of trafficker is waved through then declares he has guns and asks where he can turn around? The CO should have acted on day one and waited to be ordered to lift the off limits order.
