Whenever a law is made, and is not challenged as to its constitution validness, regardless of whether it passes muster. This is likely why Obama is not being challenged on the things he does because both parties would like a President who is less restricted by the Constitution and more like an imperial monarch.
I meant to add that when laws aren’t challenged, they become valid regardless of their validity under the Constitution.

However, House Speaker John Boehner's plan for the House General Counsel to file a lawsuit against President Obama's executive actions puts a relatively novel spin on the idea of checks and balances.
"Historically, when presidents have overstepped, or when presidents have been accused of overstepping their authority, those lawsuits are filed by actual plaintiffs who have been harmed" by executive actions, John Hudak, an expert on presidential powers from the Brookings Institution, said to CBS News. "One branch suing another branch is a very odd approach to this."

Since he’s the first “black” president anyone who calls him out is labeled a racist so no one will. 2nd he talks a good game about a problem even though he stumbles on every word about how to solve the problem, but he never takes the action to solve it. He lets the issue go beyond repair to hurt the country.
I agree they seem spineless and gutless. But, also, why are the RINOS in Washington? They are there to enjoy the trappings of their power, for a nursing home, or to enrich themselves.
