Supreme Court ruling on union dues could cost SEIU millions in payback

One of the nation's most powerful labor unions could face a costly onslaught of lawsuits seeking tens of millions of dollars in dues, after the U.S. Supreme Court ruled the money was collected improperly, legal experts said.

In a ruling Monday, the high court held that Service Employees International Union cannot force people who care for loved ones to be union members and deduct dues from the government checks of those they care for. The practice has gone on for several years in a handful of states, creating a lucrative stream of cash for the powerful labor organization, which represents more than 2 million workers and takes in about $300 million per year.

“The whole point of the decision was that the folks milked by the SEIU weren’t really public employees and should not be forced to pay union dues at all," said Hans Bader, senior attorney for the Competitive Enterprise Institute. "So they should be able to sue for refund of their compelled union dues back as far as the statute of limitations will allow.

“It could have a large effect,” he added.

Paul Kersey, an attorney and director of labor policy at the Illinois Policy Institute, which represented plaintiff Pamela Harris in Harris v. Quinn, acknowledged the next step may be to recoup dues.

"It’s something that we are looking at,” Kersey said. “We’re pleased with the decision and are definitely looking at possible options going forward.”

My wife took care of her mother for two years and had about $30 held back for dues each month. She had no choice and in fact was never even advised she was in the union until she saw her first check. I've love to see those commie crooks busted right out of existence.

No, it does not. This ruling basically makes government contract workers not subject to paying union dues for supposedly being represented by public sector unions even though they’re not members.

Did your wife’s mother have a Long Term Insurance Policy plan which paid your wife for her mother’s care?

The reason I’m asking, a friend of my wife had a sister who took care of her MIL, got paid by the LTC insurance company, and her sister had to pay union dues to these thugs.

Is so, we now know why.

What they did in Michigan was send out ballots and people tossed them in the trash assuming they were junk mail since they weren’t in the union. Then the union counted the ballots of existing members and the handful they got back behind closed doors and determined that everybody wanted to be in the union. Then they quickly destroyed the ballots before the victims knew what hit them.

It's absolutely unconscionable that this was ever permitted anywhere. It simply had to have been a fine-print/add-on/done-in-the-dark sort of law the Left thrives on. No sane person would knowingly vote for something this ludicrous.

That could very well be what happened with my wife. She no longer has any records as her mother passed six years ago. I’m sure Washington State has records, though. Wasn’t SEIU started by the same people who started ACORN?

Those parents caring for disabled family members were paid a given amount per month by Medicaid/Medicare and have been referred to as contract workers.

The unions referred to them as healthcare workers so they could collect dues.

EXCEPT FIRST RESPONDERS? They should be the first to go. Our Fire District is a disgrace. Fire Board is “packed” with firefighters who live in the district but work outside it. They’ve given their buddies so much money it’s a travesty. A firefighter now makes more than $100,000 per year base salary, and takes home at least another $100,000 in “overtime.” District policy limits the hiring of new personnel just so those already on the pad can bilk the district with their outrageous OT scam. And then theres all the high-end food they eat on the taxpayers (they only shop in the most expensive market in town). So on they go “eating until they are sleepy, then sleeping until they are hungry.” Cops are is second place, and their union needs to go as well.

Thanks to your reply, Acorn/SEIU probably got some sweet heart deal passed at the state level and maybe by Obozo’s congress.

When my wife asked me about what happened to a sister of one of her friends (last week), I was at a loss. Now I know.

The sad thing in both cases if this deduction came from a Long Term Insurance policy, the people paying for the policy had zero input to these new obscene taxes.

To your other question, basically no difference between SEIU and ACORN. Both are left wing socialist organizations with the top dogs getting rich until one went to jail.

I too was so please with this SCOTUS ruling!!!

As you may know, Dave, not all insurers reimburse the expense of immediate family member's wages for covered services. Those that do have generally always cost far more premium prior to claim than those that cover non-relative care services only.

But you probably knew that all ready. It's hard to fire immediate family members and sometime they don't do the work they bill for, if you know what I mean.
