I don’t see any way around desertion since he wasn’t where he was supposed to be AND he sent his possessions home prior to the desertion AND he snuck out rather than doing it in broad daylight.

What that means is that he (1) knew it was wrong (2) planned for it, and (3) did it anyway.

Arguing mental defect requires not being aware of right and wrong.

In my active duty time, I did have 2 soldiers have total psychotic breaks. They were institutionalized, treated, and eventually discharged to the loving care of the Veterans Administration.

I can think of a couple of ways that a basic training mental defect discharge from one service could then be re-enlisted in another service. (1) An all clear from doctors, (2) Claim of a defect that wasn’t itself officially considered harmful...homosexuality comes to mind coupled with a claim of persecution or abuse (3) lowering of Army standards to accept Cat 4/defectives due to low enlistment rates,

They white washed his DD214’s reenlistment code in the same fashion the VA whitewashed so many vets info.

At the time, the Army needed to fill their recruiting quotas and apparently was issuing waivers for people like this.

It was like that back in the 70's too. I finally discharged a thug who was a barracks thief and discipline problem. Come to find out he had a long juvenile record with serious crimes, but the recruiter took him anyway.

I recall a ‘bad” kid in my high school class was given a choice; The Iowa Reformatory at Anamosa or a free bus trip to Fort Leonard Wood.

We had a guy in the CG that was there(70’S) as he told us it was prison or the CG.He took the CG and was later jailed for breaking into the EM Club.

Let’s make a deal...fly him back to Afghanistan and drop him off to his buddies, landing or parachute isn’t required...

I’ve no use for someone who walks away from their post leaving his crew short handed while going on walkabout searching for the tallies.

Had a couple like that in my company at Cape May. They were quickly routed to the punishment company then routed out the gate.

That's the way I see it also. It was premeditated and he deserted, period.

I would like to think 0bama won't interfere by swaying the brass against bringing charges and sending him before an Article 32 hearing but will not hold my breath.

This kid is going to be protected almost as good as the president...With his family as well...

I would not be surprised if he did, at some point, sport some “stripes”...

Maybe black and white ones...that would be interesting...But figure those odds...

If they discharge him, I think it’s all over. Hamdaniya (sp) proved they can bring a discharged soldier to trial for a capital offense committed while on active duty, but I don’t think that law applies to any offense. They would have to find a way to directly link him to the deaths of those searching for him. If they ever proved he did attack Americans, they could probably bring him back for trial for that, but there’s nothing I’ve read that even suggests that.
