With the level of digital sniffing NOW apparently allowed, EACH of us is at risk. And I say EACH of us, since I dare say every one of us can be disparaged out of context or IN context on things we have communicated. This should not be allowed to be adjudicated in the court of public opinion or by the NBA.

I don't think they are lionizing Sterling himself. They are lionizing the free market system. Ownership of property is key to the free market system. That a billion dollar business can be taken away from a person because some other people are offended by statements made in a private conversation is bizarre.

Part of the free market system is the enforcement of contracts. Sterling signed a contract which says that a 2/3 majority of the team owners can force him to sell.

Moreover, a "billion dollar business" is not going to be "taken away from" him--if the League does vote to force him to sell, he is going to make a huge profit.

Donald Sterling is a Democrat.

According to the L.A. County Registrar of Voters, he is a registered Republican.

It has nothing to do with how much he may or may not make. And even contracts can be held unenforceable. Getting caught making an unacceptable remark needs constitutional review, not this 2/3 crap. But that would be his decision, of course.

What part of the Constitution protects someone against the rules of a private club that he voluntarily joined?

The whole thing stinks of hypocrisy. The NBA was looking for an opportunity to nail Sterling who they have despised since he came into the league. They lightly punished or ignored the sins of other people affiliated with the NBA. I hope Sterling sues and wins.

Who’s lionizing the old creep? The rule of law takes precedence over personal feelings. Are you saying having his team taken away for what he said in private does not disturb you? Even the creeps of the world have rights. Or so I thought.

You can look at the case of Larry Flynt who was/is a bigger creep than Sterling. But, yes, even a louse like Flynt has rights. Liberals were all behind Flynt’s rights. They love obscenity. Sterling’s...not so much.

The rules of your club do not supercede the laws of the State. It doesn’t matter if you agree to them or not.

For instance, an employer can’t pay you less than minimum wage even if you agree to it.

Homeowners associations are required to afford due process to their members and a pretty good argument can be made that the NBA is a similar type of organization which would be required to afford Donald Sterling due process before taking away his property interest in the Clippers.

Well now that would be the issue would it not!? A resourceful big-named law firm is fully capable of making hay from straw. Moreover, a “private club” and its so-called rules does not usurp Constitutional issues.

When Sterling recently exclaimed: “You can’t force somebody to sell property in America!” , he hit upon a valid defense.

If you owned a Burger King and you chose to decorate it with Klan and Nazi paraphernalia I guarantee you that Burger King would yank your franchise and leave you out in the cold. That's what the NBA will try to do to Sterling, on a somewhat larger scale. Now can they do it? Maybe, maybe not. I'll agree with the author in that the NBA rules are not that clear in that regard. But the lifetime banning and the fine? I think the author is wrong on those two. And I think that if Sterling tries to sue on those issues then he'll lose.

The Constitution protects us from government abuses. The last time I checked the NBA was not a federal agency.
