Then double jeopardy should not apply.

Truth is its very relevant. .it shows the template for authoritarian control at the flip of the race card and the left owns it..

Hell the just took out one of there own because a faction wanted something he had..without breaking a sweat..it instill fear it keeps the troops in line

In American now say the wrong word..just a word and you are destroyed..your rights are gone.

Think Bundy..

Hell think Obama..he can do anything because people are afraid. ..afraid!...in America... to even make a joke about the President..its Orwell, its 1984..

The race card is the tool the tyrants found that would work in America to instill the fear to put people in line....

Random execution of some one for a trivial offense is the time honor way of all tyrants to demonstrate power..

The left own the race card..its their tool of power..

Sterling is just some dumb slob I care less about..but I saw how fast ..how simple it was to take him down..

And that is scary power that can be use at will with evil extent.

“Are they going to ban Charles Barkley for saying “This is a Black League”?”

Whites, Hispanics, American Indians, and Asians should demand Equal Rights and Equal Opportunity in the NBA and NFL.

Shouldn’t the NBA/NFL reflect America? Isn’t that only “Fair” to settle the racial inequalities?

I was making a generalization. I was responding to the point of him being stripped of his team for ‘words’. He is in a league with other owners. I suspect that there are standards to remain in this partnership. He probably had to sign some sort of agreement. Everyone has to answer to someone.

I don’t always agree with Mark Cuban, but he is absolutely right on this.

Mark Cuban has used the n word in private conversations many times. There just weren't any tape recorders nearby.

Every time somebody is accused of racism the argument needs to be changed to: if a person approves of some blacks but disapproves of other blacks are they racist?

I don't know much about this particular case, but in general things are worse that even what you described.

If anyone (even a black) disagrees with the black liberal elite, that person is a racist. Against raising taxes? You are a racist. Favor charter schools? You are a racist.

This corrupts our society, shuts down free speech, and because of the boy-who-cried-wolf effect, actually hides true racism.

If we allow liberals to play the racist card without confronting them they will continue to do so. If we force them to define racism with a simple question we can expose the absence of logic in their conclusion.

How can a person be racist if they greatly admire some blacks but disapprove of others? Their opinion "must" be formed by another factor besides race. We cannot win this debate by playing on defense. We must attack liberals with logic:

Racism: All blacks are stupid. John is Black therefore John must be stupid.

Not Racist: Some blacks are smart and some blacks are stupid. John is Black therefore John could be smart "or" stupid. (Our determination of John's intelligence cannot be determined by his race. We must judge John on another factor.)

If a black disagrees with the liberal black elite, they are an “Uncle Tom.”

The fine is inappropriate and in a sane world the NBA would have no authority to impose such a fine.

The fine is likely legal but the lifetime ban or attempts to force him to sell his team likely isn't.

For a personal opinion, expressed privately (or so he believed)?

No more NBA for me, ever. This was private communication, that as far as I can tell was recorded illegally.

according to the NBA constitution, to which he voluntarily subscribed, he can be expelled for racist comments, which are bad for business.

That is not exactly true. The NBA exists only because Congress created an exception to the Sherman Anti-Trust act to allow the league to exist. As such it is a quasi governmental organization. It is subject to many of the same rules that would apply to cities and other governmental agencies.

I suspect that the authorization for the NBA requires that owners be subject to non discriminatory rules and certain limitations on speech. Additionally the NBA probably has a morals clause that would prohibit the owner from actions or statements that might damage the reputation of the league.

Bingo. And every one of those definitions and limits can be challenged, and proper procedure can be challenged, etc. And Sterling has the money, power and motiviation to do just that, especially since they gave him that lifetime ban. Money is one thing, but they didn't want him to pay and apologize. They wanted to destroy him. But these days, people who decide to destroy other people oftentimes bite off more than they can chew, and live to regret it. The worst thing of all is they then refuse to learn from their mistakes. From that, comes catastrophe.

Of course, this could be an act and he decided to take one for the Rats, make a lot of money selling the team, and allow himself to be used to advance the "cry racism and seize property" agenda. These days I wouldn't be a bit surprised. But if he didn't agree to that, he'll fight back, on solid grounds, in both a defense and counter-suit.

The best analogy is that being a team owner us like owning a house that’s in a HOA. You don’t get to buy the house without signing the covenants, and then you have to live by them.

I’m guessing that the ownership covenants/agreements have clauses about not bringing disrepute upon the League, with the Commissioner being the arbiter and fellow owners the path for appeal.

Since this was a private conversation between two people engaged in, ostensibly, an intimate relationship I’m certain that Sterling’s going to challenge this in the courts that whatever covenants are being applied really don’t. Assuming he’s allowed to go to the courts, because the covenants may have restrictions on that as well.

But at the very least he can sue and see where that leads him. A much better option, IMHO, is for his family to interrupt the sale decree by having him declared mentally incompetant (the conversations were being recorded, remember, at his own behest due to age related cognitive impairment) and demand that they be given custodianship of his assets. Including the team.

That would really throw a wrinkle into this, now wouldn’t it?
