Pierre man protests paying perpetual child support (South Dakota & Canada)

Both of Haraldson's children are in their 20s. South Dakota's child support laws only require child support payments up to age 18 in most cases, and 19 in one other instance.

But Haraldson, born and raised in South Dakota, was living in Canada at the time of his divorce. There, child support laws can go on indefinitely, unless he hires a lawyer and fights.

"I was told it was going to be $20,000 to $30,000 to litigate, and I'd have a 50-50 chance," Haraldson said by phone from Pierre. "I just went, 'Oh, my God.'"

Haraldson, a 52-year-old computer support specialist who lives in Pierre, has an administrative hearing with the state scheduled for Monday to protest the payments. But given the nature of state and federal laws, he may not have much luck.

I presume the payments go to the state and stay there.

would the canadian authorities try to get him extradited if he reused to pay??

I perceive that paying such pernicious penalties will presently put this poor person in severe penury and protracted poverty until he lies prostrate.

If his children are Canadian citizens, he’ll have to still pay child support under Canadian law.

Its better to pay - since he would lose money anyway trying to end it in Canada and when you become a parent, your ties to your children remain with with you all your life.

If you don’t want to support kids, don’t get married! Its that simple.

Sorry but Pierre is the capital of South Dakota, not North Dakota. Bismark is the capital of the North Dakota.

Indefiniately? His son is 22. Does he continue to pay until his son is 30? 40? Does he pay his son's retirement?

Where does it stop?

Here, unless there is a date in the court order, you have to file to have it terminated.

20-30K?

No, it might cost you $1500 though

If the keep collecting it from you long after the child is grown, do they give it to the kid or do they keep it for themselves?

Until he dies.

Of course he can petition the court in Canada to reconsider the child support order if his circumstances have changed.

But generally yes unlike in many US states - child support in Canada is a lifetime obligation.

They will simply garnish his wages.

Refusing to a comply with a lawful child support order in most states can lead to denial of US passport issuance, seizure of tax refunds and reduction in any public benefits you might be owed. You simply cannot ignore it.

Were you home schooled? Marriage has nothing to do with ability to beget children. At least they teach about the birds and the bees in public school.

Its SOUTH Dakota, not North. Don’t worry most people forget South Dakota exists and most people who live there like it that way.

Pierre has about 14k, and a WalMart. Great hunting and fishing there though.
