Can Obama’s Legal End-Run Around Congress Be Stopped?

The Constitution, many of us learned in grade school, assigns the legislative power to the legislative branch, not the executive. The Constitution also commands that the president “take care that the laws be faithfully executed.” Unfortunately, President Obama either missed that lesson or considers it inapplicable to his own administration. Thus, his promise-cum-threat, made in the heat of last year’s campaign: “Where Republicans refuse to cooperate on things that I know are good for the American people, I will continue to look for ways to do it administratively and work around Congress.” Obama has delivered on his promise and worked around Congress with breathtaking audacity. In his signature legislative achievement alone, the Affordable Care Act, the president has unilaterally amended the law multiple times, including delaying the employer mandate and caps on out-of-pocket expenses, waiving the individual mandate for certain people, extending tax credits to individuals who purchase insurance through the federal health insurance exchange and ignoring a statutory requirement that Congress and their staff participate in the exchanges. But the president’s audacity doesn’t stop with Obamacare. He has also suspended immigration law, refusing to deport certain young illegal aliens—a major reform that Congress has refused to enact. Similarly, with the stroke of a magisterial pen, he has gutted large swaths of federal law that enjoy bipartisan support, including the Clinton-era welfare reform work requirement, the Bush-era No Child Left Behind law and the classification of marijuana as an illegal controlled substance. So much for the separation of powers.

The only restriction on what a president does is the threat of being voted out of office or impeachment.

IE, this president can do whatever he desires with no consequences.

What part of our government isn’t so similarly corrupted that they would make any effort? Congress? How’s that Fast and Furious investigation going? The courts? One judge said that the Courts don’t exist to protect people from the consequences of their votes for lawmakers who make bad law, which is EXACTLY why the highest-level courts exist! How about a regular businessman who wants to just say no to an unconstitutional law passed by a crooked congress, tell it to the SWAT team, buddy!

Our Founders began the great experiment with the implicit requirement that the whole damn system can’t be corrupt in every branch and at every level. That’s what’s gone wrong here.

The constitutional remedies are in the legislative and judicial branches. The House will not impeach that traitor, no matter how much he deserves it (and the Senate would not convict). The courts are being packed with corrupt judges who don't care what the law says. We are running out of constitutional options to restrain Obama. Fortunately, there are still options, and those will become more evident as FedGov continues to lose its remaining aura of legitimacy.

So the Current Occupant now squatting in the Oval Orifice arrogates to himself the power to unilaterally change “things that I know are good for the American people” purely because he somehow KNOWS better than all of us what is good or not good for our own circumstances.

Re-read the words of the Declaration of Independence, dated July 4, 1776, and compare with the situation today. The parallels grow more striking every day.

Yeah, it could be stopped, but there is no one in politics, business, or the judiciary with enough power, money, or courage to do it. That leaves brute force as the only solution. Neither the American people nor the military are ready to use it.

Do you think it is mainly because he is black that he is getting away with breaking the Constitution? If a white man had done what he has done, he would have been impeached and removed from office. Two more years! Cna’t wait!

I think being black got him (a totally inexperienced, brain-dead choomer) elected, but it was combined with serious leftist dollars and also political and other personalities who realized that they could use this anti-American, anti-Western dim bulb to achieve their goals.

The problem is that they are very firmly installed. Obama is a sociopath who will do whatever makes him popular and powerful and gets him what he wants, and the people controlling this particular sociopath need him to be their figurehead. Hitler was at least his own sociopath.

We can't even stop the HOR, which has a majority that was elected to support conservative values, to stop from supporting Obama. They have caved EVERY SINGLE TIME they could've used the power of the purse to stop Obama. We can't even get a majority of Republican US Senators to vote with their constituents.

I'm disgusted. Instead of supporting those who elect them, they vote the interests of those who can enrich them. Until we can get Republicans to vote with us, their constituency, why are we even talking about getting Obama to stop abusing his authority?

Unless they are prepared to remove him from office they cannot stop him. He knows they will do nothing so he is going to keep pushing the envelope. It would not suprise me to see him declare martial law and take over. It will kick off CWII but he doesn’t care. He’s an idiot. Idiots do stupid things all the time.
