Woman sues McDonald’s after hot coffee spills on her lap (not again)

A woman from Clovis, Calif. is suing McDonald’s for negligence after hot coffee she bought at the fast food restaurant spilled on her lap and burned her.

The attorney for 74-year-old Joan Fino says settlement talks between his client and McDonald’s ended Thursday without an agreement. …

Fino says coffee spilled on her lap at the drive-up window and gave her second degree burns in her groin area. …

Stella Leibeck suffered second and third degree burns over 16% of her body, spent a week in the hospital, and only sued McDonald’s, who had been repeatedly warned that 180 degree coffee was too hot, refused to cover her medical bills.

Cue the violins. Perhaps the idiot should not have put the coffee between her legs. She "only" sued McDonald's, eh? Perhaps whoever built her car was responsible for her stupidity too. People like you and her should not go outside.

Drive up windows just seem to me like the ultimate in American laziness. Getting out of the car and walking to the counter and back is too much exercise? Really?

You never use a drive-thru window?

American businesses figured out that they could sell more product more rapidly, and thus increase their profit margins, by using drive-thrus. If you enjoy standing around by a McDonald's counter for 10 minutes, knock yourself out. I would much rather get my food quickly and go on about my business. It's got nothing to do with "American laziness."

That's nothing. I was once eating a nice hot meal of razor blades and ground glass, and I accidentally bumped into a pack of rabid dobermans who had laser eyeballs that burned everything they looked at, and who when they barked, barked clouds of killer bees. I inhaled the swarm of killer bees (all of whom had little tiny chainsaws) and the killer bees cut their way out of my lungs. I simply stapled my chest together, and my Priest rushed over and asked if I was okay. I said, "Never better! I feel fine!" and he got me a cup of hot steaming coffee.

I know in NH, at least, it didn’t used to be illegal to be driving with an open drink in a car—only to be drunk while driving.

every heard of putting your cream and sugar in at a table before you go to your car? I’ve been drinking coffee and cold drinks from fast food for years, never had a accident that was not my fault, because I failed to get the lid on right.

I drink my coffee from one of those steel cups that keeps your coffee hot, and a few times I’ve not screwed the lid on tight enough, the burn was my fault, not the cups’.

The drive-thru is given priority. Just compare the activity at the drive-thru with the counter next time you go in for some fast food. If it's a busy time, you will have to wait regardless.

Aww! that’s nothing. I once got my nuts bitten off my rottweilers, who then ate them. I grabbed one of them and cut off their nuts and sewed them back on to me-then I downed a steaming hot cup of coffee!

Isn’t it a state law that requires hot beverages be served at over a certain temp? I remember that we had to have a cup and a thermometer and if the coffee dropped below 160 over a period of 20 minutes or so, we had to make it hotter so it stayed at or above the legal requirement.
