Wikipedia:The Fourteenth Amendment (Amendment XIV) to the United States Constitution was adopted on July 9, 1868, as one of the Reconstruction Amendments. The amendment addresses citizenship rights and equal protection of the laws, and was proposed in response to issues related to former slaves following the American Civil War. The amendment was bitterly contested, particularly by Southern states, which were forced to ratify it in order for them to regain representation in the Congress.

Interesting how the Republicans namely Boehner specifically ruled out governmental default as means in which to prevent runaway debt. Yet, Obama made no such pledge in which to resolve the impasse in a more equitable manner without resorting to raising the ceiling.The President is confident that there are enough votes to raise the debt ceiling, as he says, to make sure the United States doesn't end of being a deadbeat. Too bad we don't have any similar approach that assures the country of the same consideration regarding the President, as eternal deadbat

It's bitterly ironic how the President intends to use the 14th Amendment to serve his own political benefit and essentially to the utter detriment of the United States of America. The 14th Amendment was proposed in response to issues related to former slaves following the American Civil War. In the next few days, he expects to use that very same Constitutional Amendment originally written to help the freed slaves to diametric polar opposite effect by using it to have us all enslaved, indentured in eternal servitude to the government for all time to come.

Fourteenth Amendment to the US Constitution - Rights Guaranteed Privileges and Immunities of Citizenship, Due Process and Equal Protection

AMENDMENT XIV of the UNITED STATES CONSTITUTION

Passed by Congress June 13, 1866. Ratified July 9, 1868.

Section 1. All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Section 2. Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State.

Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Section 4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

How does he twist this into giving himself the power to raise the debt ceiling? Is he going to declare the Republicans in a state of rebellion?

The President cannot authorize borrowing, because he has no authority to make law, and so no ability to authorize it by law.

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

Article I, Section 7, which states that “All bills for raising revenue shall originate in the House of Representatives;

I’m fairly certain “raising the debt ceiling” has the same definition of revenue, that is; the total amount of money received by the government for goods or services provided during a certain time frame.

Even a lawful president would have no power to pay debts based on the 14th Amendment. Unlike most Amendments, this one specifies the enforcement power: The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.

As for the person of questionable ancestry in our White House, it would not surprise me at all to see him trample yet another part of our Constitution.

Back when this amendment was passed there was no running tab "debt ceiling". Instead each issuance of bonds had to be individually approved by Congress. Wilson found this tiresome in WW I so just asked for Congress to approve a maximum and let the Treasury Dept. handle the individual bonds.

However, that still doesn't allow the 14th amendment's statement "The validity of the public debt of the United States, authorized by law, ... shall not be questioned" to override Article I, Section 8 "The Congress shall have power ... To borrow Money on the credit of the United States;" That power is given to Congress and only Congress.

Continuing to borrow past the debt limit is a clear violation of Article I, and any federal judge should quash it immediately, but so many are actively anti-Constitutional (cough, Chief Justice Roberts, cough) that I wouldn't be surprised to see that clear statement ignored.
