I counted 3 of them on the Hannity "expert" panel. I won't mention what sex they all were but you can guess it. ;^) Their argument was lacking beyond belief and they were also incoherent. All were lawyers.

If the Jury has a question about instructions about manslaughter, it’s because their instruction did not include that their had to be proof GZ was the aggressor to discount self defense, the State did not meet that standard (prove GZ was the aggressor), Nor did the Prosecution prove GZ was not in fear for his life. Just my opinion: I think there is one holding out, and the rest are willing to aquit. Ultimately the Judge can choose to give no further instruction, but by virtue their was a question, there is doubt. I take it as a good sign for GZ.

the whole thing about whether manslaughter is an automatic included with murder 2...whether the def was upset about THAT...manslaughter that they hadn’t been able to prep for...or whether it was the insane child abuse thingy...

We're all crazy after this insane trial, and waiting for the possibility that justice no longer exists as we know it.

To answer your question, they tried to get Manslaughter kept out of it (apparently many defense attorneys in FL make this motion), but the State wanted it. The defense certainly expected Manslaughter to possibly be included, and they may be upset that they couldn't keep it out, but I don't think that was the charge they felt blindsided by.

I think that was only the Murder 3 / Child Abuse that they were "deeply" upset about and felt blindsided by. Fortunately, Murder 3 / Child Abuse didn't go back with the jurors.

Let me see if I have this straight:

Course of action 1 (COA1) Jury comes back with NOT guilty both counts.
COA2 Jury comes back with GuILTY for Murder 2 AND manslaughter?<---unlikely.
COA3 Jury ditches Murder 2, convict on Manslaughter<----MSM running this theory.
COA3 Jury convicts Murder 2, but not manslaugter
COA 4 Jury votes NOT GUILTY on Murder 2, HUNG on Manslaughter COA5 Jury hung on both charges.

Where does the argument that Zimmerman felt an immediate threat to his life or being inflicted with grievous injury come into play?

Was the jury given any instruction along those lines?

It would be nearly impossible to conclude that Martin was trying to murder Zimmerman. To much possibility that he was just beating the cr*p out of him. But there's no doubt in my mind that Zimmerman was permitted to use deadly force due to the possibility that what Martin was doing to him was going to cause grievous injury. But from the instruction below it's going to be up to the jury to make that leap ...
