The UCMJ as written is rather clear. The problem is that a defendant is entitled to representation by a civilian lawyer if he wants one, and this a--hole can afford better lawyers than the Army has to prosecute. In general, the military routinely gets its ass kicked in court for this reason.

Yes, with full pay and allowances, and yes, he's still bound by the UCMJ. The Article 15 process won't happen because he's been elevated to "protected class". Hell, the authorities wont even classify him as a terrorist combatant but an outlier perp of workplace violence.

All true. It was also pointed out by someone else on this thread, he could demand a court martial instead of an article 15. I had forgotten about that part of article 15’s. It would just drag it out longer if he went that route.

The murders took place in front of dozens of witnesses.

In a location where military troops were on duty and not allowed to have weapons!

And they were murdered by a person who was tasked with examining the mental condition of troops returning from Iraq/Afghanistan. That little piece of information makes me angrier about these murders than anything else.

He should have been gone as quickly as Saddam Hussein was dispatched.

He will never go to an ordinary military prison. Probably spend the rest of his life in a Club Fed somewhere.

The Victory Mosque at the World Trade Center. (It's really a rabat, a place for terrorist R&R, where they can freshen up and train up for the next terror raid.)

And with KSM, too, whom Obama and the Beast Holder are determined to bring to U.S. soil for his "trial" so he can act up, act out, do his propaganda shtick, and humiliate the People of the United States on their own soil -- having already murdered 3,000 of them.
