Prominent Dems including White House chief of staff Jack Lew and House Minority Leader Nancy Pelosi have repeatedly argued in recent days that the fee for not buying insurance under the health care law is in fact a penalty and not a tax.
They got support from an unexpected quarter on Monday: the Romney campaign.
Mitt Romney's senior adviser Eric Fehrnstrom told Chuck Todd on MSNBC's Daily Rundown that he agrees - the fee is a penalty and not a tax, as the Supreme Court ruled last week.
"The governor disagreed with the ruling of the court," Fehrnstrom said. "He agreed with the dissent that was written by Justice [Antonin] Scalia, which very clearly stated that the mandate was not a tax."

Sorry RATS, you cannot have it both ways. It is either a tax or if not, the SCOTUS opinion is invalid. Also what about the decision on day one of the SCOTUS oral arguments that said the mandate was
NOT a "tax" - if it were a tax the SCOTUS would not have even been able to hear the lawsuit.

This SCOTUS ruling just cost the SCOTUS validity in the court of public opinion.

Obama's position is that the Supreme Court got it right. But they still don't want to call it a tax for political reasons, so they just won't.

FEHRNSTROM: Thats correct. But the president also needs to be held accountable for his hypocritical and contradictory statements because he's described it variously as a penalty and as a tax. So he needs to reconcile those two very different statements.
