Vanity: Today told me how Roberts would vote on Roe/Casey

Posted on 06/28/2012 2:19:50 PM PDT by jeltz25

I know this is a bit off the main topic, but today told me how Roberts would vote in a case to get rid of Roe and Casey.

Till now he and Alito haven't had to weigh in other than that fedl partial birth case which was was largely meaningless and hasn't stopped even 1 abortion from taking place since it came down.

there's no more mystery for me. If he didn't have the guts to strike Obamacare when a majority of the country wanted him to, when even Kennedy was fully on board and was ready to pull the trigger, when the moment was right, when most expected him to, etc.... there's no way he overrules a 40+ yr old case in Roe. None.

So now we have at most 3 votes in Scalia, Thomas and Alito.

Roberts won't vote to overturn Roe and Casey. Today sealed it. Alito I'm not 100% sure but I'd say he's more likely than not.

Unfortunately we're stuck with Roberts as Chief for a while.

Haven't seen the abortion issue mentioned in relation to today's decision, but it's a big takeaway for me. Roberts was a mistake by 43, just like Souter was for 41. He fooled everyone.

Harriet Miers would have voted to overturn Obamacare.

We should have just stuck with her.

That’s an excellent idea. Don’t outlaw abortions, but tax them $200k each. Up front.

She was nominated by Bush AFTER Roberts was appointed. Alito replaced Miers. Miers might well have been another Bush moderate.

He fooled everyone.

How come Democratic Presidents never get fooled into appointing even a moderate?

Roberts was nominated to replace O’Connor. Then Renquist died. So Bush removed the Roberts nomination and appointed Miers. He then nominated Roberts for Chief.

The point is that we all freaked out about Miers, when I truly doubt that she would have advanced such a silly argument as Roberts has done.

Roberts Would Overturn Roe v. Wade if Given a Chance

Chief Justice John Roberts last week made it clear that the Supreme Court over which he presides will not hesitate to sweep away its own major constitutional rulings when doing so is necessary to defend America’s bedrock governing document.

The announcement of that guiding core principle means two very big things. First, Roberts and his fellow strict constructionists on the court are now armed and ready with a powerful rationale for overturning the 1973 Roe v. Wade abortion ruling if Justice Anthony Kennedy or a future justice becomes the fifth vote against Roe

I think Byron White was their last Conservative appointment by John Kennedy.

The well is poisoned. Pick anyone from the well, and odds are they are to the left of normal people. There are a few in the well who are on the right, but you have to look hard to find them, and diligently to make sure they are solid.

They can only tax you for NOT having an abortion!

The Right can run hog wild with this ruling as well. This gives unlimited ability to tax any and all behavior even lack of behavior.

It is a dark day. i would advise all Conservatives to no longer support the military. All members of the military that are on active duty should resign. Let all the Homo's and the Libtards protect this tyrannical government!

Your likely off base. What roberts, that magnificent bastard just did was significantly restrain the congresses ability to force states to do some thing on pain of not getting $. Those 55/65 mph/21 y/o drinking smoking laws ... all are now up to what the states want, not highway $. Medicaid is about to cause commiecare to implode since blue states with busted budgets will have to kick those over 100% of the fed poverty line out on to the exchanges fully paid by DC. The commerce clause just got punked, Willard has a enormous campaigne issue, and because commiecare is a tax a repeal filibuster is off the table. All of you who who refuse to vote for willard, its up to you. If both congress and potus are owned by R then commiecare can literally be repealed day 1.

In his confirmation hearing in 2003 to the appeals court, when asked about abortion, Roberts said that the Supreme Court was clear on the matter, and he could uphold it: “Roe v. Wade is the settled law of the land,” he said. “There’s nothing in my personal views that would prevent me from fully and faithfully applying that precedent.”

Alito agrees.

Do you know anything of Roberts background and how Roberts name was brought to Bush’s attention? What are Roberts connections to Bush?
