Asking the Freeper legal eagles.

Isn’t there enough in today’s statement to sue her for liable / slander? From what I heard her say, there isn’t any evidence she can produce to substantiate her claims. It would seem that Cain can very easily show that she made public statements. Wouldn’t the burden then be on her to prove that her claims are true?

I’m not a lawyer, nor do I play one on TV...(but I did have paralegal training...)

The legal barrier to Cain SUCCESSFULLY suing this woman for slander and liable, is that we currently basically have a two tier standard—one for normal people, the other for “public figures” (mainly celebrities and politicians).

A public figure must not only prove with a preponderance of evidence that an accusation was false—which is the traditional standard to win a slander/liable case—he must also prove “malicious intent.”

Since this woman appeared to be a supporter of Cain before this—she’s the textbook example of one it would be hard to prove had malicious intentions....

Surely this is why the libs picked up on her. Most don’t know though, that the political world is FULL of such floozies—who just hang out at political functions to schmooze, meet famous people, and maybe, find a rich husband. (see listing for “ARIANNA HUFFINGTON”)

I actually knew a woman, VERY liberal, who was a volunteer on the Ollie North campaign....only, apparently because she had the hots for Ollie. He never really talked to her—but it was odd—some just like politicians, and hanging out at political such affairs, while at heart totally confused or apolitical about this issues.
