Schumer confirms White House considering ignoring debt limit

This morning we speculated that Treasury Secretary Tim Geithner was seriously considering just ignoring the statutory debt limit by claiming it was superseded by section Four of the 14th amendment. Sen. Chuck Schumer, D-N.Y., confirmed that that course of action has been considered by the White House. Talking Points Memo‘s Brian Beutler reports on a conference call with Schumer today:

I asked Schumer, a lawyer, whether, in his view, the administration had the power to continue issuing new debt even if Congress fails to raise the debt limit. He acknowledged that the question’s been discussed, but said the White House probably shouldn’t go there just yet.

[emphasis mine] Considering the ease with which Obama has violated bankruptcy law, refused to enforce voter fraud laws, and ignored the War Powers Act, what is stopping him from ignoring the debt ceiling.

The debt limit only constrains Congress. It's like a Congressional rule, you can't break it, and neither can the president.

Seems to me like it's been broken several times. Didn't we just have this same debate a couple of months ago? How was it resolved last time?

Nothing. NADA!

He has said one term might be enough for him plus he has many things yet to accomplish in this term. Based on the things he has done up to now in this term, he has no compunction about ram roding anything he decides to do down everyone’s throats.

We are in a heap of trouble and it is compounding to the point of him bring a Dictator in fact, not just in actions.

God help us in our day to save America from tyranny and socialism. Thank you, Father that you hear me and always fulfill your Word, in Jesus name amen.

Clinton was impeached...the house did a great job on this...the senate wouldn’t convict him but he will always be tagged as impreached....

... all that voted for Obama, or voters that chose not to vote and stayed away form the ballot machines, did a very bad thing and it might cost us everything. Obama has no conscience.

Not me I spotted him right away and tried to warn everyone I knew. I was met with a blank stare. Kind of like a Cow in a herd. It did not compute in their compromised minds.

I wasn't saying the debt limit couldn't be broken, I'm saying that YOU can't break it. It's a law that does not constrain you. The law is supposed to constrain Congress, against it's own spending action.

The debate a couple months ago was based on the existing/current debt limit, and was one of "when will we have spent (what Congress told us we had to), up to the limit that Congress told us to spend to (the debt limit). "Oh, the money runs out in May. No, wait, July. No, wait, August. No, wait, September."

Congress is simply not a credible operation.

This is what Center for American Progress (CAP), John Podesta and Soros, advised them to do after losing big in November.

Basically rule by regulation, executive order, or whatever it takes. Bypass checks and balance powers.

Yes, but you missed my point. There will be no impeachments for at least a generation, probably longer. Conservatives already played that card. Same here in California. No more recalls of governors since conservatives played that card with Davis (and gave Schwarzenegger).

So have any of these people read the whole amendment or are they just hoping no one does? This was enacted to guarantee northern debt would be honored and southern “confederate” debt would not be. The important line on enforcement of the 14th amendment is section five.

The president is limited to enforcing congressional legislation, not ignoring it or bypassing it. Not enforcing the amendment by making new law.

If Obama unilateraly blows past the debt limit, that will be 100% on him and the Demon Rats. The Republicans will have their hands clean on this one.

Poll after poll shows voters don't want to raise the debt limit, at all, or at least without drastic spending cuts.

It will be a bloodbath in 2012 for the rats if they blow past the debt limit without spending cuts.

I say bring it on. The supermajorities in the House and Senate and control of the White House means that President Palin will be able to do some real cutting.

I hope he does. That would be the first truly serious grounds for impeachment that we’ve seen since Nixon.
