Emily Good to sue Rochester Police Department (videotape at traffic stop)

The Rochester woman whose run in with the law with her iPhone and made national headlines, plans to file a lawsuit claiming Rochester police violated her civil rights.

Donald Thompson, attorney for Emily Good, told News 10NBC's Ray Levato Tuesday they may sue the individual police officer involved in her arrest, the Rochester Police Department, "any or all of the above and that's something to be discussed and considered."

Good was arrested in her bare feet and pajamas while standing in her own yard one night in May while taping a traffic stop that happened in front of her 19th Ward home. Good kept recording even after an officer asked her to stop and go inside. She was charged with obstructing government administration.

Monday, the District Attorney's office asked City Court Judge Jack Elliott to dismiss the charges because a review of the evidence showed there was no legal basis to prosecute.

Thompson says, "Her stated reason for video taping in the first place was that three white officers were stopping a young black male. And she's obviously attuned to social issues and concerns. There's nothing wrong with monitoring the course of those proceedings to make sure the correct procedures are being followed."

Thompson says says the lawsuit will claim a violation of Good's civil rights under the guarantees of the First Amendment. He said they will either file it in state or federal court.

"There was no crime that she committed here," says Thompson. "There was no basis to arrest her. There was no reason to forcibly take her from her property. It's a violation of her civil rights."

"It was pretty far over the line," says Thompson. "That's why it went national. "

My glasses are for far vision, not near. I can defend the actions because he acted appropriately. This woman was out to obtain notoriety, and find any reason to file a law suit. I find it infathomable how anyone would support this cretin.

After. Issued citations on a very broad street (high snow area during the winter, so streets are broad) for parking more than 12 inches from the curb. That’s being a public nuisance under color of authority,

Haven’t watched the video, but based on the article it looks like the cop acted like an idiot. No question.
Stupid cops are still going to act stupidly. You can’t fix stupid. Rodney King incident didn’t put anyone on notice. Crap like this keeps happening so that ain’t working because you can’t fix stupid.
Screw liberals and screw their rights. They are the biggest tyrants in the country. Let me clue you in. They would put you in a reeducation camp if they could get away with it. Be as noble as you want. As for me, they are our enemy and need to be treated accordingly.
Fire the cop and charge him with unlawful imprisonment if the case merits it, but no money for the leftist swine and her shyster.

No, I watched this video, numerous times. Others on this thread, and another, apparently are not very good with their observational skills with respect to the positioning of this woman relative to where the officers were standing. Any good attorney for this office will use the video to show that the officer acted appropriately.

Okay, you got me to flip back again. I was all about how this chick was in the wrong for suing.

Now I think I need to lawsuit to go forward to prove copsuckers wrong.

However, since your eyesight is shot out, when the verdict comes down, I promise I will read it to you.

Yet another person who wants to equate something that happened somewhere else with what happened in this case. As appropriate, I take these case by case, and do not try to paint all LEO’s with a broad brush of totalitarianism.

Maybe you’re right.

But Big Tough Policeman should have thought of that as a possibility before acting like an ass.

I hope it puts pressure on this cop from his supervisors, and from the public.

The main thing, this abuse got exposed on the national stage (a very important thing) and it shines the spotlight on what is becoming a pattern of abuse nation wide.

Maybe the “crass” lawsuit will at least keep the issue before the public long enough to be helpful.

That could be a wonderful and very healthy side-effect, rather than let the story be buried and forgotten.

I'm absolutely shocked that a left wing loon, out looking for an excuse to sue police, filed a lawsuit in this case/s After watching the video numerous times, she'll lose the case.

I think the lawyer is looking for some quick shakedown money. He doesn't want a trial.

Okay, I watched the video. I don't see how she will win. The officer was polite and asked her numerous times just to go inside. He didn't aske her to stop taping; he didn't try to take her camera. He calmly told her he did not feel safe having his back turned to someone who had apparently made very anti-cop statements prior to the video being turned on, especially since she insisted on standing as close to them as she could while still being on her property.

I have seen a bunch of videos where the cops are abusive and try to intimidate bystanders to prevent them from being videotaped. I have seen videos of cops going after people standing a block away to keep them from being videotaped. That was not the case here. I think if this woman had even moved back to her porch and continued taping, she would have not been arrested. But for her to be standing a few feet away, after apparently expressing her anti-cop sentiments, could reasonably give the cop a reasonable fear for his safety and the safety of others.

Did you happen to pay attention to this woman’s proximity to the traffic stop in making your determination? Are you of the opinion that the officer could not have possibly felt unsafe with the person there because she’s a WOMAN? I have a challenge. Next time you see a traffic stop, or any police action for that matter, try walking up within a few feet of the officers and see what happens.

Too bad the individual officer that made the wrong choice doesn’t have personal consequences, like having to pay it or have his personal liability insurance dinged.

Cops should be required to have a form of “malpractice” insurance.
The underwriters will make sure that malpractice is penalized monetarily, or by dropping them (which would preclude them from being cops).
