In-state tuition for illegal immigrants is preserved with California Supreme Court ruling

The California Supreme Court decided unanimously Monday that illegal immigrants may continue to be eligible for in-state tuition rates at the state's colleges and universities rather than pay the higher rates charged to those who live out of state.

In a ruling written by Justice Ming W. Chin, one of the panel's more conservative members, the state high court said a California law that guarantees the lower tuition for students who attend California high schools for at least three years and graduate does not conflict with a federal prohibition on giving illegal immigrants educational benefits based on residency.

California is one of several states that permit illegal immigrants to take advantage of lower college tuition for students who attend high school and graduate in state. About 25,000 illegal immigrants are estimated to receive in-state tuition rates in California.

A group fighting illegal immigration challenged the California law on behalf of U.S. citizens who pay the higher tuition as out-of-state students. The group won in lower court, and the state appealed.

The lawsuit contended the California law usurped a federal prohibition on giving educational benefits based on residency to illegal immigrants but not all U.S. citizens.

On the face of it, that makes absolutely no sense. Did the court think lower tuition was not an "educational benefit," or did it interpret the Federal statute as applying only to Federal benefits such as grants or loans?

I read it to mean that the “in-state-tuition” benefit was granted based on attending California High School, NOT residency, so it passed federal muster.

I guess if you live outside of California, but sneak across the border and attend 3 years of high school, you could also get in-state tuition.

I would recommend instead that we all avoid sending our kids to college in California, since they might learn all sorts of bad habits out there.

This ruling does nothing but support the Hispano-Racist groups who continually push Illegal Alien Amnesty

The court basically ruled that CAL does not have to follow Federal Law....however, when a state passes a law not to the liking of the Hispanic Ku Klux Klan....it is shot down because the “States have no authority in Federal matters”

The courts deliberate inconsistency regarding Illegal Aliens and the racist Hispanic groups is nothing more than anti-American bigotry against Americans

So, is the Court creating separate and unequal classes by saying that illegal aliens, who are not citizens, are entitled to rights that are denied to Americans? Or is the Court saying that ALL out of state tuitions are illegal?

In any event, this is not settled yet. There will either be a Supreme Court hearing OR there will be a mass protest against paying out of state tuition.

The whole idea of out of state tuition is a bad joke. When my job brought me to DE, my wife and I bought a house, paid DE taxes and could vote - but I had to pay out of state tuition for the first year of grad school! Seems the state had its rules and the university had its own.

A U.S. citizen from a state other than California should sue for California in-state tuition.

CA has a budget shortfall of $25 billion dollars over the next 18 months, yet spends many billions per year on illegals. It’s a good thing the other 49 states WILL bail us out so we can keep supporting the illegals.

It brings a sentimental tear to my eye when I think of how illegal immigrants can receive in-state tuition when as a resident of the USA, my kids must pay out-of-state.

Getting sucked into this absurd argument was a huge mistake. It’s like debating whether an escaped convict can get a senior discount on a movie ticket. Um, does it matter? There’s kind of a larger point here: WHY ARE ILLEGAL ALIENS BEING ADMITTED TO PUBLIC UNIVERSITIES?

The insanity here is not that of the judges, but of the California Legislature, which explicitly wrote into California law that illegal aliens are entitled to in-state tuition if they attended high school in California.
