The question I have is, did an officer order him to disarm and in an attempt to follow those orders was shot because he “reached for his gun”... Witness said the police issues “confusing” orders to him before they shot him for “not complying”.

Costco can, and should, still be liable for wrongful death. I would like to see the employee charged as an accomplice to murder for fabricating a danger. If Costco does have a no gun policy, then I agree; sue the bastards.
