The group backing Birther Army Doctor Terrence Lakin as he makes his way through the military justice system announced today that Lakin is waiving a preliminary hearing that was set for Friday.
Lt. Col. Lakin refused orders on the grounds that Barack Obama is not eligible to be president. It is now up to Maj. Gen. Karl Horst, Military District of Washington Commander, to decide if the case will go to trial, said Chuck Dasey, spokesman at Walter Reed Army Medical Center in Washington, where Lakin is assigned.
The American Patriot Foundation said in a press release: Saying that the Army has made it "impossible for me to present a defense" at the Article 32 "preliminary hearing" previously scheduled for June 11, 2010, Lt. Colonel Terrence Lakin has officially waived -cancelled--that proceeding. Therefore, the case will move inexorably on to a General Court Martial.

No. if the CIC, correctly installed or not, starts giving the Army orders to do clearly illegal things commensurate with a dictator, then the Army has a decision to make. If the guy the Congress, the Supreme Court and the Executive Branch recognize as President is signing orders to continue doing the stuff the Army has always done and fight wars we were already fighting under his predecessor, the Army salutes and does it.
Lakin tried to have the military verify that the CIC’s eligibility had been proven.
If the military leaders had any honor they would have gone to Nancy Pelosi and said, “You signed a certification that Obama was Constitutionally eligible. Our soldiers need to know on what basis you swore that, because if you’re lying that means that the CIC can’t issue any legal orders.”
The fact of the matter - as we now know - is that neither Nancy Pelosi nor anybody in the DNC has EVER asked to see Obama’s documentation. Nancy Pelosi got her “oath” out of her rear end just like she gets everything that comes out of her mouth.
She needs to be locked in jail for a very, very long time. In a just world she would also be shining Lt Col Lakin’s boots.

Or perhaps it would concern his own Indonesian citizenship and his possible lack of ANY type of U.S. citizenship? The list goes on. So, yeah, I guess you’re right, in for a penny, in for a pound. OK, kids. Let's pull out our Constitutions and actually read the document. The power to raise an Army is exclusively Congress's and is not the President's. The Army is not some private Blackwater that Presidents have raised. There are a series of laws Congress has enacted that establish and organize the Army. They're in Title 10, U.S. Code. Look it up. The authority of the officers of the Army, commissioned and non-commissioned, is Constitutional and flows from these laws. There could be no President in office and their orders would still have to be obeyed. The orders Lakin got were not from Obama and were perfectly legal.
How far are you willing to take this? Last year's class of officers were given their commissions by Obama. Are you saying their commissions are invalid? They aren't really officers? Do they owe their pay back to the government? Can Private Beetle Bailey tell his butter bar to shove it, he doesn't have to walk guard duty because his officer was appointed by Obama?
Read your Constitution. Like it or not, he was elected by the Electoral College whose votes were read out in Congress. He was administered the oath of office. If he is not Constitutionally qualified for office at this point there is one remedy for that - for the Congress to institute impeachment proceedings.
Nothing in the Constitution empowers the Army to judge the qualifications of a President. Nothing. In fact, the Constitution makes clear the Army is subject to the control of the civilian government, not vice versa. We don't do coups in America.
In my opinion Lakin and his supporters are damaging the institution of the Army by trying to put it in a position to judge the President's qualification for office. It needs to stop.

So if a usurper sits in the White House who gained that position by fraud, deceit or even violence, just theoreticlally here, the military (you said Army) must slavishly follow him no matter what illegalities got him in that position.

Impeachment is for actual presidents, not ones who used illegal means to hide their ineligibility and commit crimes by doing so.

When this first started I thought Lakin was well-meaning but misguided and should be dealt with leniently. The more I hear from his crazed supporters who seem to want the Army to pull some kind of a military coup, I think he needs to do prison time to send the message loud and clear that soldiers must continue to obey orders and do their duty despite having a POS for President.
