Senate votes ... but many lawsuit challenges already taking shape

Well, this morning is the biggest Senate vote of all-time ever. Or at least the next one ever. On healthcare. no longer called healthcare reform.

Yes, as Arianna Huiffington points out here, this Senate bill leaves absolutely no special interest behind. Not a one

But ..a series of legal challenges are certain. . Good news for any involved attorney with holiday bills.

And if happy Harry Reid and nattering Nancy Pelosi amend the bill's language in anticipation of the emerging legal concerns, then the carefully-calculated political deal -- or sale, depending on your viewpoint -- could crumble.

"This thing may be stillborn even if it passes," said one attorney involved in preparing a legal challenge.

When a similar requirement was under consideration back in the first Bill Clinton administration, analysts called it "an unprecedented form of federal action" similar to the military draft and doubtfully authorized by current laws.

Republican Sen. Lindsey Graham of South Carolina said his state would be filing suit, charging that the numerous sweetheart deals like Nebraska's violated the Constitution's equal protection clause. More details here.

"Speaker Pelosi won the vote for her version of health-care reform by 220 to 215. If three votes had switched, the opposition would have won 218 to 217.

...My guess is that Reps. Bart Stupak (D., Mich.) and Joseph Cao (R., La.) will switch to no because the Senate bill is more abortion-friendly. Some other Democrats might come along with Stupak... If Stupak, Cao, and one progressive flip, and nobody flips Pelosi’s way, she loses the vote."

And now that the Senate has voted and gone home, the conference committee has to do their work.

I saw on another site that the House is on vacation until Jan. 12th, and the Senate is on vacation until Jan. 18th. So the actual conference committee won’t start work till after vacation.

Will we see some more Senators and Representatives get hammered in “town hall” meetings as they meet with constitutents over the break? Considering how close the margins are in both houses to pass this thing, if anybody has 2nd thoughts, the next series of votes could tilt the other way.

It is time to grind this runaway government to a halt. The streets of Washington should be in gridlock for months. All the main arteries around the capital need to be packed with millions of real Americans. It should not function in the status quo.

Nullification sounds good to me.

And I’ve heard that lawsuits could be filed if this thing passes. I don’t know the chances, but it would be great to see a court injunction against it, until such time as legal challenges are resolved.

I don’t know if the bill could be stopped by the courts pending legal challenges, but it would be good if it could. Can we go “judge shopping” the way liberals go judge shopping to get their favorable court rulings from sympathetic judges?

It’s time to move the battle to the states. The states which cannot “monetize” their debt.

Time to dust off the tenth amendment and roll with it!

An interesting question could be : can the states “opt out” of this under the 10th amendment? This could be an important legal question if lawsuits are filed over Obamacare.

I’m praying that the House (pray not as blinded by the Senate and seats are a lot more vulnerable) will be a little more aware of the public backlash of a bill that does not provide a public option AND requires people to purchase health insurance and will vote no.

I doubt they are having “town hall” meetings while they are home. Is there any tea-party type plan to visit the local offices of the senators and reps before 1/12/10 in some kind of organized (”astro-turf”) manner?

And the lawsuits will be a total waste of time as leftist judges will rule that no one has “standing.” How about 60 million armed Americans surrounding the Capitol, demanding that the Healthcare fraud be repealed—or else. Guarantee it will be repealed.

Just got back from slumming over at DU. There are a lot of people over there that are angry as hell at what has been passed, and for the same reasons many of us are.

The Congress had a chance to do some things that really would have brought some relief to the health care insurance mess, and they did the EXACT opposite.

It gives me hope that some over there understand the unconstitutional nature of this legislation!

My governor is in Nebraska. I am not sure why he would pursue legal action to have the Nebraska deal withdrawn. While I am positive he was not in favor of the deal, did nothing to encourage it, and afterward expressed dismay and betrayal over it, seems like he is in a bad position to try to have it revoked at this point.
