Supreme Court Silent on Obama Birth Certificate Lawsuit

2008_12_05_scprotest.jpgThe Supreme Court made no announcement today whether or not it will hear Donofrio v. Wells, the lawsuit challenging the election based on Barack Obama's release - or alleged lack thereof - of his official birth certificate and his citizenship status. (The court did decide to hear two cases, one of which is the case of Ali Saleh Kahlah al-Marri, an Al Qaeda combatant seized on American soil.) Of course, there's no guarantee the Court will ever actually issue any statement on the Obama case since it was simply petitioned to the court and, along with hundreds of other cases, could be dismissed without any comment at all. But as Frank James, over at The Swamp, says, "the lack of an announcement doesn't mean the court definitely won't hear Donofrio." So either we will or we won't. Hmm.

Meanwhile, our comrades at our sister site DCist scoped out a protest held by supporters of the Donofrio cause at the Supreme Court this morning led by Roger Bredow, who claims Obama has duel citizenship.

The Supreme Court will announce whether it will actually consider the Obama lawsuit as early as today and as late as Monday. If (as expected) the Court tosses the suit, Bredow will start challenging Obama's legitimacy based on "foreign money that went into his campaign." Other protestors said they'd start contacting members of the Electoral College. Steve Brindle, who drove down from Pennsylvania, said he'd called his senators yesterday.

"There aren't a lot of people out here today," said Brindle. "There are a lot of people talking about this back home. Really, everyone's asking questions."

Of course, only 15 to 20 people showed so...yeah.

Either way, nothing will ever outweigh the rage we felt this morning when we read that Obama has allegedly chosen a Zune over an iPod. We're whipping up a petition as we speak and expect a protest very, very soon.

Whereas previous presidential candidates were born outside of the United States of America and were understood to be eligible to be President; and

Is there a link for the assertion that this was inserted in the resolution by Obama?

Also anyone know which previous presidents were born outside the U.S.?

Not necessarily... According to what I was reading — because of his mother’s age and the guy she married being from Kenya, Obama would not qualify to be a citizen. The mother wasn’t old enough, you see, even with her being a citizen. She had to have been in the U.S. a certain number of years by a certain age or Obama would not qualify. That’s the problem, you see...

This is true, if he was born in Kenya and if the marriage was legal, she needed five years of residency after her 14th birthday. She was just under that. If the marriage, however, wasn't legal, he could fall under single parentage or unknown parentage and the residency issue may not apply.. It can get crazy complicated... Let's just say I'm glad I'm not a SCOTUS judge and just someone clicking away about it on a keyboard...

It’s sort of a half-lie, in a way. He’s referring to the original founding fathers. They had to exclude themselves from that “natural-born” requirement or else none of them could run for President. But, it didn’t apply to others after the revolution.

Other than the founders, Chester Arthur, who may have been born in Canada (he claims Vermont but opponents at the time charged he was born in Canada.)

You also have at least six Presidents who had one or both parents born in another country. (Andrew Jackson had two foreign born parents; Jefferson, Buchanan, Arthur, Wilson and Hoover had one parent born outside the US.)

I think he was just hoping it would go away. It won’t.

He’s smart enough, I think, to know that even if he was born in Hawaii, the facts and circumstances of his case may still raise an issue as to his eligibility. There may be only a remote chance that the law could go against him, but no one in his position would want to take even that remote chance by subjecting his facts of legal scrutiny.

Someone said this is very reminiscent of the Clintons. Just brazen it out and brazen it out and brazen it out and you may dodge the bullet (no matter how remote that consequence was in any case).

I don't feel that way about the SCOTUS.

Picture if you will the biggest “geek” classmate in your school. The one that gave a presentation at the Science Fair that even the judges had to check resources....The musician that knew great details of the Classics...or the girl who read every novel in the library...

Now put a law degree and a copy of the constitution in front of that type of individual and multiply it by nine. One is not going to be outdone by the other.

Very seldom do they get to work on a real bona fide constitutional issue, and they are going to make sure every section is done to perfection......

It is their chance to go down in history....To be THE justice with THE opinion that is quoted forever. THIS is what they have waited a life time to expound upon, a culmination of their “nerdiness”...No way are they going to mess it up or miss their big chance.

I don’t know whether or when Ann went to Kenya.

My comment was as to the birth announcement and why it might have been published.

There’s always a chance it was published to make Ann’s situation socially correct-—she was 18 after all. She may actually have been married and married at the time baby Barack was born, but it probably wasn’t a conventional situation with a big wedding, showers, and so on. Maybe her family simply wanted to announce that Ann wasn’t a floozy teen, but a married woman who had legitimate child. Just in case the neighbors were wondering.

You are so right!

I will be praying as I have been. It is the most powerful thing I can do.

But I will tell you what I won’t be doing.
I will not write another letter, fax or email concerning this subject or any other to my elected officials, the media, and the the Supreme Court Justices.
They are not read anyway. And most probably get a good laugh out of them.

I am making a list of who is on the right side of good and who isn’t. If someone (anyone) is silent or dismissive of this subject, then THEY ARE THE PROBLEM!

I will wait to pass my full judgment of the SCOTUS until I fully know if they are completely cowering from this issue.
I think they are, which astounds me, but I will be a little more patient.

The only thing these a$$ wipes understand is money and power. If we stand any chance of taking back our Country we need to understand this.
Taking away their money will take away their power. They will listen to that.

Again. I will be praying for comfort, understanding, and for knowledge of what I need to be doing concerning this issue and every other crap thing our government is doing with our money. AND THAT INCLUDES THE KILLING OF THE UNBORN.

I don’t know about anyone else, but I will not let this die.
I just don’t know what the best course of action is.
I will be praying for guidance and justice.

I suggest we all do the same.

Yes, I’m glad I’m not the one trying to sort out these facts. And how could Obama answer them even if required to?

He knows the burden of proof is on him if it comes to that and how could anyone in his situation prove much of anything regarding his parents, their legal status, his birth and subsequent citizen status, etc. Plus he has made many, many statements in the course of his books that could be used against him if he changes stories.

Surely McCain should be considered a natural born citizen even if he was born in Panama. It strikes me as silly to say someone is not a citizen at birth merely because their parents were outside the country at time of birth, especially if they were on official duties for the government, as McCains parents were. I find it hard to believe that anyone would argue McCain is ineligible because hes not a natural born citizen. In any case, thats a terrible reason to persist with a fight over Obamas citizenship status.

My understanding is that “natural born citizen” means “citizen at birth”. McCain surely passes this test. I think Obama does too, because his mother was a citizen at the time of his birth.

Certainly some clarity from the SCOTUS would be helpful here. All this discussion about where a person was born doesnt seem very relevant anyway (except in a legalistic sense). Whats really important is where a person grew up and spent most of their time. A person can be a natural born citizen, but what if they spent almost their entire life living elsewhere, say Iran, and dont know much about life in the US? Imagine this: POTUS is born in the US to citizen parents, who then moves to Iran, where the future POTUS lives until he is 35, at which time he runs for president and wins. But it OK because the constitution only requires that he be a “natural born citizen”.
