Obama is "NOT" qualified to be President of the United States Lawsuit Against Obama Dismissed from Philadelphia Federal Court

(Lafayette Hill, Pennsylvania – 10/25/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court. The case is Berg v. Obama, No. 08-cv-04083.
Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court.
This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?
So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned.
According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

We must legally prevent Obama, the unqualified candidate, from taking the Office of the Presidency of the United States,” Berg said.

They were studying within a quarter mile of each other for two years and had mutual friends, radical professor Edward Said being one.
Altogether they spent 4 years in New York from 82 till 85 when Obama moved to (SURPRISE!) Ayers' home town of Chicago.

wasn’t there an incident last January where somebody was caught looking at Obama’s passport files or state department files. Bush admin was first accused but cleared of any violation of wrong doing. Who was looking at the records?

That is not what happened in the Senatorial race. He had competition throughout and was not expected to win. The expected winner was a wealthy businessman, Blair Hull, who was prevented from winning by the timely revelation of a sexual harassment suit against him and some dirty divorce laundry if I am not mistaken. The other of the three top candidates on the Democrat ballot for Senator was Daniel Hynes.
While it is true they are effectively disenfranchised, they have legal representatives in the electors who do the actual voting for President. If the candidate is not legitimate, they cannot do as their constituents have demanded; hence there is harm.
The question I answered was 'If a citizen does not have standing, who does?' The answer I offered is a rational explanation that suggests "who does" have standing. You may be able to argue that a citizen should have standing, but that doesn't change the legitimacy of the answer. My take is that either an elector or a state SOS is the optimal choice.
That is not the issue. Standing is like me filing a case to have you divorce your wife. I have no standing legally to do so.
You are speaking of authority. And the Court gets its authority through the People via the Constitution and Congress. Standing is different than authority.
I think that's the problem. There apparently IS no entity. Let's be real: If any one of us had Obama's history, we would never even pass the background check for a low-level security clearance. This is one of those things that I think we have assumed to be taken care of, when in fact it is not.

Actually it is just the opposite. Most of Washington’s powers came because of his enormous popularity which made opposing him very difficult. It could only be done surreptiously or risk political suicide. This was the course Jefferson took from within the Administration and he came as close to treason as one can get. He certainly incurred Washington’s hatred by his actions so much so that by the end of his life he would not allow Jefferson’s name to be spoken in his presence.
But Washington’s extraordinary power was no due to a different understanding of the Constitution but because he was Father of Our Country.
Presidents have steadily become more powerful over history with perhaps Roosevelt the most powerful certainly after Lincoln.
