Supreme Court nominee Samuel Alito enjoys sufficient bipartisan support to surmount any Senate filibuster attempt by minority Democrats, members of both parties indicated Friday.
A final vote making the New Jersey jurist the nation's 110th Supreme Court justice is scheduled for Tuesday, hours before President Bush gives his State of the Union address to Congress and the nation.
Democrats and Republicans both said that the 55-year-old conservative jurist will get more than the 60 votes needed to cut off debate on the Senate floor Monday. "Next Tuesday, a bipartisan majority will vote to confirm Judge Alito as Justice Alito," said Senate Majority Leader Bill Frist, R-Tenn.
Alito's supporters already have those commitments, with 52 of the Republicans' 55-member majority and three Democrats Robert Byrd of West Virginia, Tim Johnson of South Dakota and Ben Nelson of Nebraska already publicly supporting his confirmation as the replacement for retiring Justice Sandra Day O'Connor.
In addition, Democratic Sens. Kent Conrad of North Dakota, Daniel Akaka of Hawaii, Ken Salazar of Colorado and Byron Dorgan of North Dakota as well as GOP Sen. Olympia Snowe of Maine made it clear after a second day of floor debate on Alito that they would not support a filibuster, even though Akaka and Salazar oppose Alito and the others are undecided.
After meeting with Alito on Friday, Conrad even said he was "more favorably disposed" toward the judge.
"We're going to have a vote Tuesday morning," Democratic leader Harry Reid of Nevada said. "Everyone knows there are not enough votes to support a filibuster..."

I almost wish the democrats would fillibuster. that way the world can see them as the obstructionist, whining babies that they relly are.
i get the sense of a building backlash against all the democrat party-before-issues that have been going on for the past few decades. methinks that when puch comnes to shove, more people despise democrats than republicans, and it's becomming mainstream.
"can't wait to see his mug when he gets off of Teresa's plane, what a glutton."
He's on C-Span right now explaining to the American public that he doesn't know what 'Unitary Executive' means..
THE VOTE ON C-SPAN IS:
56 YES 33 NO
STEVENS (AK) VOTED YES
DAYTON (MN) VOTED NO
He's probably pulled out his biology book and looking under Urinary. He is in the right book and he knows what he can do with the rope.
Wait, the Miers supporters were saying no way we could get someone like Alito confirmed because of all the RINO's...
Alito, Luttig would get 47, 48 votes, max.
Not all of us. Many people simply believed that she should have gotten her hearing and didn't like the way she was trashed. Most of us also believe that Alito is a much better qualified candidate and thought he would probably be confirmed.
I agree with you, I think most people are fed up with the Democrats and we will see more evidence of that soon. I think it's becoming mainstream to regard the Democrats and the liberals as pathetic.
At the end of the Miers debacle, it was clear she wouldn't have had the votes to pass through the committee.
Almost everytime she spoke to a Senator, the Senator came out of the meeting against her.
But, all is forgiven now.
Not all of us. Many people simply believed that she should have gotten her hearing and didn't like the way she was trashed. Most of us also believe that Alito is a much better qualified candidate and thought he would probably be confirmed.
Should that, perhaps, just perhaps, have been "...some people simply believed..."?
At any rate, the right guy will be in shortly....we may all hope.....please let things get very lonely for SC Libs.
I am delighted to report that not only the Colorado news outlets, but his own Senatorial web site indicates that Senator Salazar of Colorado is NOT going to support any kind of filibuster.
I actually took the time to call his office today and thank him for NOT supporting any kind of filibuster.
The evidence occurs on the first Tuesday in November 2006.
Here is to hopes, prayers and wishes that the WV media mogul who barely lost to Rockefeller (big money grandkid), will unseat this poor example for an able bodied US Senator.
Otherwise he will die in his office or on the Senate floor. If that happens, lets hope a Republican governor is there to nominate his successor.
you may get your wish. We can only hope that Ginsberg or Stevens departs in the next three years and one can assume that after the Miers fiasco, Bush will be wise enough to nominate another solid judicial conservative. Then it's game on for the libs and their silly little filibuster game. We all know that if trading O'Connor for Alito has them this riled up, trading a Ginsberg or Stevens for Janice Rogers Brown or any other solid conservative on GWB's bench will really get their panties in a lather!
That is not a picture I needed in my mind's eye...ugggghhh.
Vote on C Span
There is a big O next to Lincoln Chaffee's name. The weiner has no testosterone and needs to see how everyone else votes before he commits himself. I am sure he wants to vote NO but that would sink him in the upcomming primary and as I said he has no.....
ted kennedy with lathered panties - too terrible to contemplate!
Why the hell do we have to wait until Tuesday? I'm sorry, but allowing the Democrats to stall stall stall stall stall stall stall stall stall is b******t.
They stalled the hearings from last year, they dragged out the hearings with a record number of questions, they stalled the vote in the committee, and now Frist is letting them stall the vote on the floor. It's CRAP.
Frist isn't encouraging me to vote for him in any primary, I tell you that much.
