Martha Stewart Sentenced To 5 Months In Prison
Special to EconomicBriefing.com July 16, 2004- Choking back tears, Martha Stewart told the court on the day of her sentencing, "Today is a shameful day for me, my family and my company...I have been choked and suffocated... Peace be with you."
She was then sentenced to 5 months in jail, followed by 5 months home detention. During home detention she will be required to wear an electronic monitoring device, but will be allowed to leave her home for up to 48 hours per week to go to work.
Stewart also received 2 years probation and a fine of $30,000.
The judge will recommend that Stewart serve her 5 months at the minimum security prison in Danbury, CT.
Stewart was required to choose one residence as the residence where she will serve her home detention. Stewart chose her home in Bedford, New York.
The sentence was stayed pending appeal by Martha Stewart.
Following the sentencing Stewart gave a brief statement outside the court house where she reiterated that it was a shameful day for her and that "... a small personal matter has been blown all out of proportion with venom...into a circus event."
Immediately after the sentencing Martha Stewart Living Omnimedia (MSO) stock soared to $11.07 per share up more than 30%.

Amazing how they minimize their sins and fabricate the sins of others. How can insider trading be "personal" for an officer of the NYSE?

Oh, sure she did. Lost something like $30 million when the price of her company's stock dropped. Paid who knows how many millions in legal fees. Will never be able to hold a position of trust or serve on the board of any public company. Will spend much of the next three years in confinement or reporting to a probation officer. All of that for telling a lie to cover up a stock transaction that probably was not illegal in the first place.

My life took the turn after years of insider trading. It was thrilling and exciting, and I was getting away with stuff, ya know? Then, for some reason, it stopped being thrilling and exciting, so I started doing Home Decor, Flower Arrangements, and so forth but that still didn't give me that "high" I was accustomed to... Suddenly, I was on drugs, selling corsages out of the back of a van in Manhattan to feed my addiction...

This whole prosecution is bogus. I'm no fan of Martha stewart but since when in America do we prosecute folks for "lying" to the FBI during the course of an investigation of a crime for which we're never charged?

The crime she was convicted of was proclaiming her innocence on a matter she was never charged with.
She was never charge with insider trading; she never committed perjury.
Are you telling me that it is now a felony in America for a person being questioned by the police to assert their innocence?
She did break the law and she was found guilty. She is as guilty as any bank robber, but of course we Americans have always subscribed to the double standard of "white collar crime" getting more lenient treatment than other types of crime.

At least the DOJ went after her. In fact, this administration has gone after more big crony capitalists than any other administration since TR. One after the other they are putting them away.
The mood was "anything goes" during the lawless Clinton 90's and clamping down on these robbbers is welcome and overdue.
