I'm in the middle of the road on this story. Stewart commited a crime--tried to cover it up and could have gotten a stiffer sentence. She is not above the law. Now the other side: "Domestic Diva"---the keyword here is "domestic"--something that surely ruffles the feathers of the N.O.W. crowd: can't have rich, successful, shrewd, business women promoting a revival in finding simple joys and rewards in homemaking.

Very unusual for the judge to depart downward from the maximum Sentencing Guidelines "points" for a convicted defendent who fought through trial and has no remorse or "acceptance of repsonsibility".
She caught a break.

The Clintons were above the law. Why wouldn't others think they too can be above the law?
Like I continue to say - the consistent enforcement and prosecution of the law, despite a persons standing in society, wealth or position is paramount to the actual force of the law itself.
Do you honestly think we are consistent in our enforcement and prosecution of perjury laws, insider trading laws, or obstruction laws?

So - for example "gay pride" parades where naked men can run around New York / Seattle; or where Black Panthers get to bring their AR-15s to their meetings and brandish them about... (just a couple of examples and not trying to throw red herrings) - since police tend to look the other way . . . local laws concerning public decency and/or bearing your weapons should be what (dropped or 100% consistently enforced)? I'm thinking Martha got caught, she got tried, she got convicted. She's guilty. Should insider trading be legal? Maybe that's the question.

amazing how many conservatives hate Martha for her politics and want the legal system to punish her for listening to her broker. I agree, I think that she was made a scapegoat by the SEC. At that time the SEC couldn't get Ken Lay at Enron, they couldn't get Bernie Ebbers at Worldcom, so they go after Martha. I do question if Martha would have given money to the correct politicians if this would have happened.

It should be enforced as close to 100% as humanly possible. Insider trading is pretty damn tough to enforce consistently. Thus, either build up the resources necessary to enforce it consistently or change the law. In this case, I happen to think Stewart was targeted because of her name, her position, and her wealth. That's the part I have a problem with.

Doug, just look at the comments here.
Securities fraud is a big issue. Folks may invest their whole life savings into stocks by trust. I heard there are 700 other investigations taking place that we won't hear about. Most stem from 5,6,7 years ago when Clinton was the code of the day.
Why do Republicans always have to clean up RAT messes?

We always have to clean up their messes. Unfortunately, the RATS in my state of California have created such a mess that I don't think it can be fixed.
