He is their father and has rights but as their mother has passed the grandparents are quite likely to get visitation rights if they file.
They need to be proactive though as they were living with the GPs it can be shown that it is in the children’s best interest to maintain contact with GPs. But they can’t let much time pass before acting.
Yes and the fact that they lived in a different state makes it that much more difficult. I have a good friend that is an expert in family law and he has been advising us on the GP’s options and they are very few.
