Sunday, August 3, 2003 1:00 AM EST Fox: Witnesses Support Kobe Accuser

Two hotel workers will give supporting testimony to the the claims of a 19-year-old Colorado woman that she was raped by Kobe Bryant.

Fox News' Rita Cosby reported on her weekend "Big Story" program Saurday night that two hotel employees of the Lodge and Spa at Cordillera have given Eagle County, Colorado police investigators accounts that are consistent with claims made by her accuser.

One hotel employee reportedly saw the girl moments after she left Bryant's room and describer her as "shocked and upset."

Shortly after, the girl was driven home by a hotel bellman.

Cosby reports that the bellman said the girl told him she was "forced to have sex with Kobe Bryant."

The bellman also noted that the woman's clothing had been torn.

Sounds like Kobe may have had an "assist" from the bodyguards?

I heard Rita's report. It was disturbing. The talking head lawyers said it will be admitted under"excited utterances" rule and their credibility will be what the defense will go after.

Obviously very important testimony, if true.

(Good to see that the gag order is so effective.)

I heard this report. I was watching Fox. Rita is usually pretty reliable. Also, I believe the DA knows about this girl; he knows about the depression, Suicide stuff etc. Therefore, he has to have other evidence. He knows Kobes big $$$ attorneys are going to attempt to destroy this girl (maybe the Kobe lawyers are working behind the scene right now). Injuries (reported in multiple articles) and witnesses are bad news for Kobe.

The story is on the FOXNews website, too:

http://www.foxnews.com/story/0,2933,93630,00.html

A co-worker of the 19-year-old hotel employee who accused Bryant of assaulting her June 30 told Fox News the woman was visibly "shocked and upset" after leaving his room.

In addition, Fox News has learned that the woman told another co-worker who drove her home after the alleged assault that she had been "forced to have sex with Kobe Bryant."

The co-worker, a bellman at the resort, told friends and fellow employees at the Lodge & Spa at Cordillera (search) that the woman was crying after the alleged attack and her clothing was torn. He also said he drove her home minutes after she emerged from Bryant's hotel room. It had previously been believed that the woman waited until the following day to tell anyone about the alleged incident.

When reached by Fox News, the bellman, also a friend of the accuser, said he had been instructed not to talk about the case.

Not sure how much this hearsay evidence is worth, even if it is addmitted.

The evidence will be admitted as under the "excited utterance" exception to the hearsay rule. The fact that the bellman is a friend of the alleged victim will not affect its admissibility, but it will give Mr. Bryant's lawyers an avenue to attack its credibility.

I daresay that if it is buttressed by photographs and medical testimony, it will be worth something.

At this point, this is just another "media report", but I'm interested in seeing how many of the virulent Kobe defenders around here will want to discuss this, as opposed to the 500-post threads when there's a media report making the girl look bad. And I wonder how those sycophants will feel about all their blind support (and I include Boortz and Hannity) if it turns out a rape did occur.

At some point it's going to come down to if the Defense can get jurors to believe that everyone except Kobe is lying. Is everyone lying (doubtful) except Kobe the great? Keep in mind, the infidelity and (if true) sodomy will affect the jury and what they may believe about Kobe's credibility.

Have you heard ANYONE tell you the manner in which it was said? Nope. Excited utterance is not determined by the content of what she said, but rather the maner in which she said it. If she reported these facts to her bellman friend in a calm or normal fashion, there will be no exception to the hearsay rule.

Kobe defenders (including Boortz and Hannity)will find some unlikely scenario that "proves" the girl is lying and of course a "whore" (name calling is particularly nasty).

I will bet that this testimony will be admitted. I don't know too many cool and calm rape victims.

From the FOXNews article:

A co-worker of the 19-year-old hotel employee who accused Bryant of assaulting her June 30 told Fox News the woman was visibly "shocked and upset" after leaving his room.

So, let me get this straight. She's visibly shocked and upset, but her tone of voice will determine whether it is an "excited utterance."

According to Rita Cosby's report last night, the girl was crying.
