When Justice Stevens refers to "the world community" to bolster his decision he's really refering to "people like me, enlightened internationalists."

Essentially, the rule of a sovreign people through it's legislatures is being trumped.

Within our system of government is there anything Congress can do to reign in SCOTUS?

A perfect response.

Our justices need to understand they're on the bench to interpret AMERICAN law. Foreign laws are not to be used, or given any weight, when doing so.

This quote -

drives me nuts. My reaction is "So what?" The death penalty is "overwhelmingly disapproved" for anybody by the "world community". Why should supposed mental retardation be a mitigating factor in a cold blooded murder? The punishment should fit the CRIME, not the criminal.

I suppose it would be bad to wish that Thomas misses the plane and that the plane subsequently crashes killing at least four on board.

Don't forget the structure of the EU constituton. The DOCUMENT grants rights, not God. That means they can be un-granted, too.

I guess "someday" means "15 years ago" in Journalism school.

Thompson V. Oklahoma from 1988: "...The conclusion that it would offend civilized standards of decency to execute a person who was less than 16 years old at the time of his or her offense is consistent with the views that have been expressed by respected professional organizations, by other nations that share our Anglo-American heritage, and by the leading members of the Western European community. ... The death penalty has been abolished in West Germany, France, Portugal, The Netherlands, and all of the Scandinavian countries, and is available only for exceptional crimes such as treason in Canada, Italy, Spain, and Switzerland. Juvenile executions are also prohibited in the Soviet Union."

This debate fell under the rubric of what is "cruel and unusual punishment." That verbiage is relative enough that a conservative could argue the founding fathers wanted it to be interpreted in light of contemporary standards (though they ought to be American standards, not world standards). The abuse of the "due process" clause is not such. That has been dumbed down into "whatever new entitlement the world thinks to be fair, to hell with the facts."

How can it succeed with Bush unwilling at present to support a constitutional amendment, sending for the lawyers clowns who are already firmly ensconced in positions of power.

For some reason Bush won't fight the court.

This nation needs leadership and he is not up to providing it. That has to change for impeachment to work.

Impeachment is the constitutional remedy for judicial sodomy.
