The death of a fetus in Steelton was ruled a homicide after the mother said a man tackled her during an assault, knocking her to the ground where she landed on her pregnant belly.
The incident last year resulted in the death of the fetus, which was 31 weeks and four days gestation at the time of his death, or less than nine weeks away from his due date.
The mother named the baby Arkamble. He was delivered stillborn on May 23 and pronounced dead May 30.
Steelton police never announced the assault or death to the public, but PennLive found out about it while reporting end-of-the-year homicide statistics. Even then, police and prosecutors would not reveal any details about the death to PennLive.
These details come from the recently released autopsy report:
The Dauphin County Coroner’s Office ruled the fetus’ death a homicide as a result of multiple traumatic injuries caused by blunt force trauma.
At first, Arkamble’s parents told the coroner’s office — and a Swatara Township detective — that Arkamble’s mother was riding a bicycle that didn’t have any brakes when she rode down a hill in Steelton, hit a bump and wrecked the bike.
But weeks later in July, and after the coroner ruled Arkamble’s death a homicide, Arkamble’s mother, 18, revealed abuse she said she experienced at the hands of Arkamble’s father, who was 31.
He once tackled her as she tried to “get away” from him, she said, according to the coroner’s office death investigation.
When he did so, Arkamble’s mother landed on her belly, she said. The baby’s father continued beating on her sides and abdomen during the incident, she told authorities. The woman said she suffered abdominal pains for days after the incident, and two days later, her water broke.
Although the father initially told police Arkamble’s mother refused to go to the hospital, she told police he did not want her to go to the hospital.
The Dauphin County District Attorney’s Office has not yet filed charges related to the death, and has not publicly identified a suspect. Prosecutors, however, say the investigation is continuing and that a suspect has been jailed since last year, one month after the assault, on sex crimes in a separate case.
Arkamble’s mother, who is now 20, tried to leave the baby’s father after Arkamble’s death, she told a coroner deputy and detective. She said he hit her and stabbed her with scissors, lifting her shirt to reveal two scars to the deputy and detective, the coroner’s office wrote in its investigation. No charges have been filed in connection with the incident as it is part of the overall investigation.
Wayne Ross, a forensic pathologist who contracts out to central Pa. counties, performed the autopsy of Arkamble. He noted numerous contusions, bruises and hemorrhages across the fetus, including those affecting his liver, heart and bowel.
Ross also noted the fetus suffered swelling to the brain due to direct contact forces, which resulted in his brain being deprived of oxygen. Arkamble died by homicide from multiple traumatic injuries due to maternal blunt force trauma, Ross wrote in his opinion.
Under Pa. law, defendants can be charged with murder of an unborn child, facing the same penalties as a regular charge of murder. An unborn child is defined by Pa. law as “from fertilization to live birth.”
Pennsylvania is among 31 states that deem non-abortion deaths of fetuses at any stage of development as homicide. Other states require viability outside the womb or define victimhood only in the latter stages of pregnancy.
I just note aloud that even extreme Left prosecutors will charge for two murders if a pregnant woman is killed.

If I were a defense attorney, I’d argue that putting my client on trial for homicide of an unborn child is a threat to abortion rights. I’d bet a few women on the jury would be persuaded by this and vote not guilty.

The law is schizo on this and its a horrible legal precedent to decide personhood based on a womans subjective personal feelings, which constantly change.

I will never understand how the state can allow a doctor to murder a child and it not be considered a homicide as well.
