Supreme Court Opinions [2/21/24]

SCOTUS issued opinions at 10:00 this morning on the following cases:

We have two opinions, apparently. The first is from Justice Jackson, in McElrath v. Georgia. It is unanimous.

McElrath v. Georgia, No. 22-721 [Arg: 11.28.2023] Issue(s): Whether the double jeopardy clause of the Fifth Amendment prohibits a second prosecution for a crime of which a defendant was previously acquitted.

The court holds that the jury's verdict that McElrath was not guilty of "malice murder" by reason of insanity constituted an acquittal for double jeopardy purposes despite any inconsistency with the jury's other verdicts.

The state court's decision is reversed and remanded. Justice Alito has a concurring opinion.

Second case is Great Lakes Insurance v. Raiders Retreat Realty. Decision is by Justice Kavanaugh and it is unanimous, with a Thomas concurring opinion.

The Court holds that choice-of-law provisions in maritime contracts are presumptively enforceable under federal maritime law, with narrow exceptions not applicable here.

The deadline was yesterday 2/21 for prosecutor Jack Smith (of J6 fame) to respond to the Supreme Court with their requested information. Waiting to hear what became of that process.

I expect Jack will file his response sometime this afternoon and demand that SCOTUS rule that he can do whatever he wishes under the “Trump exception” to all laws and legal precedents. He will further demand the Court to order that Trump is not allowed a defense; not any defense at all, in order to save “muh democracy”.

Heck, Smith should follow the New York precedent and deny President Trump the trial. Have the judge make a summary judgement of guilty and then move straight to the penalty phase.
