Jack Smith wants to put Donald Trump in jail because Trump aggressively interpreted aspects of the Electoral Count Act. However, other people (not connected to Trump) were far more aggressive. They decided to completely ignore a constitutional requirement that had been firmly settled by the U.S. Supreme Court.

Who were those lawbreakers? They were revered justices of the Supreme Court of Hawaii. Will Jack Smith or Merrick Garland put those justices in jail? Will the Hawaii bar association suspend their licenses? Will anyone even comment on their defiance? Don’t hold your breath.

The Spirit of Aloha Legal Standard

In Hawaii, a man named Christopher Wilson was charged with a felony for violating three gun laws, but the charges were dismissed by a Hawaii circuit court in 2022. The court reasoned that the charges against Wilson violated his right to bear arms, as guaranteed by the Second Amendment of the Constitution.

Recently, however, the circuit court’s ruling was reversed by the Hawaii Supreme Court. According to the Epoch Times, the high court of Hawaii decided the case based upon a new legal standard:

“Article I, section 17 of the Hawaii Constitution mirrors the Second Amendment to the United States Constitution. However, ‘we read those words differently than the current United States Supreme Court. We hold that in Hawaii there is no state constitutional right to carry a firearm in public.’”

The court explained its defiance by citing the Spirit of Aloha standard.

“Hawaii’s historical tradition of firearm regulation rule out an individual right to keep and bear arms under the Hawaii Constitution… The spirit of Aloha clashes with a federally-mandated lifestyle that lets citizens walk around with deadly weapons during day-to-day activities.”

A new-to-me legal concept. We just read it differently.

Slavery can be legal in Hawaii because the court reads the words “neither slavery nor involuntary servitude...shall exist within the United States” differently.

Masterful how the commie democrats have destroyed this country. Just load up the courts with communist judges and watch the havoc they evoke. Hopefully a day of reckoning is forthcoming.

Just load up the courts with communist judges and watch the havoc they evoke.

That was the plan all along. We were warned about it in the 60s and the left did everything they possibly could to ignore it and enable the infiltration.

I guess the court choses to be blissfully unaware that nearly every adult male walks about every day with deadly weapons provided by God, namely hands and feet.

Then of course the modern world is filled with so called deadly weapons of opportunity, hammers, screw drivers, steak knives, the list is endless.

It is foolish to assume that people will not kill each other because they don't have a firearm.

Sadly true that the Democrats have loaded up the judicial arm with their placed puppets putting political agendas over the rule of law. It's within Congress's power to re-write the framework to limit the powers obviously abused by this now predominately single-party branch of government populated by jumped-up attorneys who were chasing ambulances not long before. It takes courage like our Founders had to do so.

But oh wait...Rep or Sen So-and-So got in with best intentions but got compromised by the "You've Got to Play Ball" spiel or blackmailed after some hardy parties...oh my!

We HAVE to require term limits and far more public awareness. If the politician is excellent they can run again after four years. Hard call in this time of ostriches hiding their heads in the sand of media distraction and video games but there it is.

Is that it? Do the Hawaiian SC get the final word?

Is the poor guy who was arrested and convicted for exercising his Constitutional rights still languishing in prison?

I hope this can go to a federal court, and that some good lawyers take the case for bono or we can gofundme the guy.

You must be aware of all the wrongly imprisoned January 6 people suffering horrible conditions on the basis of their leaning toward patriotism over Democrat rule . They must be freed, fairly constituted and formally apologized to for the suffering and torture they’ve endured at the hands of this usurping regime while the autocrats who put them there serve in their place.

"Spirit of Aloha" is reserved for the "correct" people and the "correct" beliefs.

Not some dirty smelly maniac that "reads the Second Amendment" the same as the United States Supreme Court and 120 million gun owners in America in 2023.

Or so says the Supreme Court of Hawaii.

Looks like the Supreme Court of Hawaii is paddling a leaky canoe and should have paid attention when the charges were dismissed by a Hawaii circuit court in 2022.

Now they are gonna get their nose shoved in "it."

I love the revived "Hawaii 5-0" series as it depicts a well-run state protected by lawmen dedicated to justice. Great writing with good actors but...

All fiction because nearly all the natives utterly resent we "howlies" and truly wish rescinding statehood to resume a singular kingdom. Now that Hawaii's formerly strategic importance as our mid-Pacific base has been rendered moot by modern technology and an altered geopolitical map I say let them have that and good luck.

Wouldn’t hurt losing that other Democrat lock state of California, either. Both are now huge drains on our productivity with nothing to return except tourism destinations. I think I might still have one of those 48 star flags in storage.
