Trump demands jury, says New York AG has 'no case' in heated testimony

Former President Trump demanded a jury Monday after his unprecedented time on the stand, calling the civil trial against him and his businesses a "disgrace" and saying New York Attorney General Letitia James has "no case."

Trump described his forced testimony as "election interference" while maintaining that his net worth is "far greater" than financial statements during testimony Monday.

The former president and 2024 Republican presidential front-runner took the stand Monday morning in the non-jury civil trial stemming from James’ lawsuit against him, his family and his businesses. James alleged Trump defrauded banks and inflated the value of his assets.

Trump has denied any wrongdoing and has repeatedly said his assets were actually undervalued. Trump has repeatedly said his financial statements had disclaimers, requesting that the numbers be evaluated by the banks.

"I think this case is a disgrace," he said, adding that people are being "murdered" in New York as James is "watching this case."

"It’s a disgrace. It is election interference because you want to keep me in court all day long," Trump said while on the stand after testifying for more than five hours. "And Judge … I want a jury."

One of Trump's attorneys, at the end of the former president's testimony, said that in "33 years," they have "never had a witness testify better."

"An absolutely brilliant performance by President Trump. He's not backing down. He's told everyone the facts," the Trump attorney said. "Now that the American people know what's going on, maybe something will change."

James, a Democrat, sued Trump, his children and the Trump Organization last year, alleging that he and his company misled banks and others about the value of his assets. James said the former president’s children – Donald Jr., Ivanka and Eric – and his associates and businesses committed

Trump has point on the jury.

The judge ruled Trump was guilty of fraud by summary judgment and there is almost no way even an open and shut civil fraud trial could adjudicated by summary judgment .

It was my understanding that Trump was not entitled to a jury trial because the New York state law under which Trump is being sued calls for the judge to handle the case as an “equity” case, rather than a case at law. In an equity case, the judge sits as a “chancellor” and there is no jury. If it were a case at law, Trump would be entitled to at least a six person jury.

That said, I think the judge screwed the pooch when he blurted out that he had no obligation to listen to Trump’s testimony. He absolutely had a duty and an obligation to listen to Trump and weigh his credibility and demeanor, as well as with all other testimony in the case. He all but admitted that he was not going to afford Trump a fair decision based on the evidence.

Trump’s people need to move for a mistrial immediately, and if it is not granted, to file emergency motions with the appellate division seeking a mistrial and flat out dismissal of all charges based on the judge’s outrageous prejudicial conduct.

I agree 100% with Mark Levin; both Engeron and James need to be disbarred immediately.

You are aware that Trump was the one that started freezing evictions at the federal level before the states started doing it too. It was his idea. So landlords have nothing to be happy with him for.

I don't know the law on the subject in NY, but Trump's attorneys need to file for recusal of the judge, if not a mistrial. Any judge who says that he won't listen to a witness shouldn't be hearing that case. If the judge won't recuse himself, then it should get appealed immediately, or reviewed by the appellate court by a prerogative writ, i.e., mandamus and/or prohibition.

Let me add, I’ve always said if innocent, have no jury. If guilty as hell, ask for a jury and then baffle them with bullshit to stand a greater chance of being found innocent.
