Carlishia Hood, 35, had been accused of getting her son, 14, to shoot dead Jeremy Brown, 32, on June 18.
Charges against the two were ditched after Cooks County State Attorney Kim Foxx announced her office had backtracked on the charges.
Brown could be seen yelling at Hood to 'get your food!' as she starts to argue with him.
While she continued to yell back at him, he shouted: 'Oh my God, if you say one more thing, I'm going to knock you out.'
He then took a big swing and punched her, with other customers in the store looking on in horror and running away.
Foxx initially charged the mother with murder and contributing to the delinquency of a minor – but has since dropped the charges after a new video of Brown repeatedly punching Hood came to light.

You shut your “damn mouth.” How you like that?
Shut up.
“And most everyone here would be rightly defending the boy’s use of deadly force. Why not now when the boy is black?”
There’s a subset here…
Why did a 14 year old boy have a gun in his pocket in the first place? If a 14 yo white boy had shot that same black guy for punching his mother, you can bet that there would be charges filed.
Did the shooting happen while the man was attacking the woman or threatening her, or when he was walking away?
I agree that the mother and son would have been prosecuted had they been Caucasians, but she and her son were clearly within their rights in defending themselves against this thug (who was busy beating up on the mother).
As for the son, probably there should be some kind of citation if you really want to enforce gun laws, but I’m sure in his neighborhood nobody goes out without a gun to protect themselves or their families. That’s what we have let our cities become.
I would like to know a little more about what happened indoors but the biggest factor would be learning more about the kid chasing the unarmed wounded man down to finish him off.
Yeah, I agree. It’s a bit complicated.
“ I agree that the mother and son would have been prosecuted had they been Caucasians.”
Maybe not if the guy beating the woman was also white.
It depends on how it happened. If the headline is accurate, "ordered by mom to SHOOT man dead after he beat her up," there would be nobody defending them. (That sounds like she was no longer in danger of bodily harm, she got the son and had the son go shoot the guy.)
If the guy was still beating the mom and the kid shot him, then good shooting.
There might be some comments about a subset of the population that almost invariably votes for more gun control laws not facing charges for violating the laws that are already on the books, and I'm not sure I see the issue there.
The problem isn't that these people are NOT being prosecuted. The problem is that some different people likely WOULD be prosecuted for essentially the same action.
As for me ...
As a juror, I will not convict anyone of any felony in connection with taking out the trash.
Good outcome.
Now drop the charges against Marine Daniel Penny in New York.
Have you seen the video? He was definitely not unarmed with the way he was pummeling her. The fourteen year old acted in defense of others at least during the first shot.
As I understand it, she was licensed for the gun and her son got it from her car.

She asked him to take out the ‘trash’ and as a good son he did.
And more details from a report yesterday - the kid shot him once while in the establishment, then followed him outside and shot him again.
What I remember is he was first shot when attacking her but that was not the only shot fired.
He retrieved her legal gun from their car is my understanding.
He was definitely beating on her during the first shot. No idea what happened outside with the second shot. I don’t know if the assailant was still threatening and aggressive or trying to retreat.
No doubt meritless garland would stick to the “No different!” treatment claim for some people. Hmmmm? Kyle was actually assaulted with a weapon and got charged. Weird huh? Butt, Chirac so....... Maybe because no AR was used?
“I was under the impression that being assaulted in such a manner was regarded as reason to respond with equal deadly force because a reasonable person would rightly fear serious bodily injury or death.”
You are correct, but that’s not what happened here. According to this article, “He took out a gun — which his mother was licensed to carry, according to the local station — and allegedly shot Brown in the back. The wounded man fled the restaurant but was followed by the young teen and his mother, who reportedly told her son to keep shooting and kill the man. The teen fired more shots — striking Brown a total of two times, according to prosecutors. The man later died of his injuries.”

While deadly force may have been justified in the first instance, shooting the attacker in the back as he retreated and was no longer a threat is criminal homicide.
