The Trump trial problem hiding in plain sight: Good luck putting together a jury for this one

One of those little unexpected perks in life is being able, in our electronic age, to email well known, well regarded experts all over the world and, sometimes, if one is lucky, receive a reply. This writer has, over the years, exchanged emails with historians, investment bank officers, journalists, legal analysts, (he said, proudly) late former New York City mayor Ed Koch, and others.

It was during one such correspondence, with a well known, well respected attorney and legal analyst, that I posited a problem I saw with the Trump documents case.

I am keeping the analyst's name confidential. What matters is that this expert agreed that the following analysis does indeed identify a problem.

The problem has to do with the need in any trial to ensure an impartial jury — no easy task in these highly politicized times if the defendant is Donald Trump.  Harvard professor emeritus Alan Dershowitz, in a recent article, stated one such problem: Trump was indicted under the Espionage Act, even though the indictment contains no charge of actual espionage.  "Espionage," Dershowitz pointed out, is a highly charged word, evoking images of the most egregious betrayers of America, people like Robert Hanssen and the Rosenbergsa word, according to Dershowitz, sufficiently prejudicial to a jury as to require the judge to declare a mistrial if the word "espionage" is merely uttered at trial.

But there's another problem, one apparently not identified, at least not publicly, by any expert or journalist.

Can there be any potential juror who has not seen at least one of the following photos?


In these photos we see dozens and dozens of boxes transported from the White House to Mar-a-Lago, filled with classified documents.

Or do we?

"Boxes and boxes of classified documents" was, certainly, this writer's, and surely much, if not most, of the public's impression.  But the actual number of "documents with classified markings" recovered by the FBI is...102.

One hundred two documents.  Total.  Not enough documents to fill one box, let alone the many boxes in the above photos.

In Manhattan DJT will be convicted...after 45 minutes of deliberation. In DC he’ll be convicted...20 minutes of deliberation. In Miami he just might get a hung jury.

Surely, the FBI could have consolidated these 102 documents into a single box and photographed — and leaked — only that box. Or dispensed with a box entirely and simply stacked and photographed the documents on a table.

So what's with all those boxes? The purpose, obviously, is for a corrupt, politicized FBI and Justice Department to create a false impression in the mind of the public, to make Trump's possession of 102 questioned documents appear much worse than it actually was!!

This is a non-issue, since the event is not meant to be an impartial trial, but a show trial.

If they could get away with it, the DOJ would stage something similar to the 1938 Moscow trials, some of which can be seen here.

It would be difficult to assemble an impartial jury, but I don’t think that will be the plan.

Dozens of Declassified Boxes is more like it. The President can declassify anything he wants to. This is such BULL SHEET. The American people can’t be this stupid to fall for this or are they?

You betcha. Trump’s defense will be able to get a few prospective jurors dismissed. But then the liberal judge will step in, and put an end to that.

Trump might successfully appeal that to a higher court. But in the meantime he’ll be convicted.

Now that Trump has legal standing to be in court, Trump’s lawyers should argue that Joe Biden has no lawful right to be the 46th President given Amendment IV and Amendment XIV, Section 3.

Amendment IV provides that:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated...

The Brady Bill Joe Biden (and Chuck Schumer) voted to approve violates the Amendment IV right to be secure in the possession of firearms listed on 4473 forms as it is quite reasonable to believe a confiscation list could be compiled from 4473s and federally required gun dealer records.

Quotes on an Amendment XIV, Section 3 use by a judge:

A judge in New Mexico declared Tuesday that the Jan. 6 Capitol riot was an “insurrection” as he ruled that Otero County Commissioner and “Cowboys for Trump” founder Couy Griffin must be removed from office for participating in the attack.

Griffin is barred for life from holding any federal or state office — including his current role as county commissioner, from which he will be ousted “effective immediately,” Judge Francis Mathew ruled.

Griffin became “constitutionally disqualified” from those positions as of Jan. 6, 2021, the judge concluded.

With a weaponized FBI and DOJ? Any MAGA person on that jury who doesn't vote to convict will get the Jan 6th treatment.

Meanwhile, leftists DC jury members can post on twitter to brag about voting guilty before the trial even begins without any consequences whatsoever.

The white file boxes depicted can hold 10 reams of packed paper, 500 sheets per ream = 5000 per carton. Assume the boxes aren’t full, and aren’t packed like new paper, and you easily can still likely average 1000 pages per box. The brown boxes are larger...

I presume the article’s first point is that it is impossible to avoid using the word “espionage” when the defendant is charged with violating the Espionage Act, i.e. committing statutorially-defined Espionage.

Next problem: what juror does not know who Donald Trump is, and have a pre-formed positive or negative opinion of him? The only jurors that can be seated are vegetables or liars, with “both” being another possibility.

But, this case should never make it to a jury. Everything about it is a question of LAW, not fact. Jurors could possibly determine whether Trump physically possessed certain sheets of paper, but are not competent to address the make or break legal questions or whether that possession was illegal.

Our greatest fear is being tried by twelve people not smart enough to get out of jury duty...

“That was, in my view, the biggest problem with the JCPOA. I thought it was a bad deal at the time, and I did not hide my view. “This is what we did in recent years. One, we upgraded our intelligence to greatly increase the number of targets. Second, we increased the number of munitions and systems needed to attack Iran, with the process now at a peak. Third, we built operational plans. Fourth, and most important, we are training for this. We finished two drills. One was during the IDF’s War Month, and the second was at the end of November. We are about to hold a third very large exercise.
