Manhattan DA has no authority 'to enforce federal campaign finance crimes': ex-FEC commissioner

Manhattan District Attorney Alvin Bragg's case against former President Donald Trump is legally "dubious" and motivated by political ambition, alleges legal expert Hans von Spakovsky.

"It's an extremely dubious prosecution, and I say that as a former commissioner on the Federal Election Commission," he told Just The News.

Von Spakovsky, the manager of the conservative Heritage Foundation's Election Law Reform Initiative, said Bragg is going after Trump for alleged federal election crimes that are not within his jurisdiction.

"No local state prosecutor has the authority to enforce federal campaign finance crimes in the first place," he explained. "There's just nothing from a factual and legal standpoint to this case. But I don't think this prosecutor cares about that. What he's counting on is that he's in Manhattan. Manhattan is one of the most liberal jurisdictions in the country. I think he believes that he can get a liberal jury to convict Trump, no matter what the facts are and no matter what the law is."

This is a really good article quoting a former commissioner on the Federal Election Commission as to the legal authority of Alvin Bragg to prosecute Trump on federal campaign finance issues.

“It’s perfectly legitimate to pay a settlement,” he noted. “It’s perfectly legitimate to have a nondisclosure agreement. And Bragg’s multiplying that into 34 accounts, that in itself shows a lack of credibility. When prosecutors take a single incident, or two incidents and turn it into three dozen supposed violations of the law, that’s a sure sign that the prosecutor doesn’t have a case and is trying to overwhelm the jury.”

Bragg’s a Democrat. He wouldn’t let the law stand in his way. Be wary of the judge.

All this is pure speculation because Bragg never charged any crime.

What was the underlying crime here?

Bragg did not say the crime was an attempt to evade federal election law.

That is what all these pundits and morons say.

Bragg says he does not need to reveal the alleged crime.

But for our side to be so hyper-focused on the alleged crime being federal election law blinds us to other avenues these fascists may take instead.

Re #4: because the DA is not seeking to enforce federal law. Trump is not charged in NY with violating federal law, he is charged with attempting to conceal a crime which may or may not be a federal violation.

No doubt, this is an evil political prosecution, but the adverse legal opinions expressed by “experts” have one thing in common, they do not know what they are talking about.

Someday we on the Right will thank Mr. Bragg for his fine work to prosecute a former president. His work will be quite useful when charging the Obamas in North Dekoda or Ohio will political crimes being now created by the current pResident in the WH by EO. We will a 100 DAs charging the last two democrat presidents, and thousands jamming up the legal system going after everyone down to the dog catchers. Lawyers are out of control. This is also why the democrats are so busy destroying the prison system. Just have to shot most them;)

A person is innocent until proven guilty of the federal crime. So by definition no crime is being covered up. My guess is Bragg is still looking for a crime.

Well, the first judge is the one presiding over the case

He happens to be the same judge that handled the case against the Trump Organization.

He also donated to Uncle Joe.

His daughter worked on Uncle Joes campaign.

There's not a judge...or a court...in the State of New York that will put a stop to this. DJT’s plan should be Federal court.
