US Army Sergeant Found Guilty of Murder in 2020 Shooting of Gun-Wielding Protester

A jury on April 7 convicted a U.S. Army sergeant who shot dead a man wielding a gun at him during a protest in 2020.

Sgt. Daniel Perry, working for Uber, traveled to Austin in July 2020 for work. A Black Lives Matter protest was happening the same night. Perry, after turning down a street, found himself surrounded by protesters.

Garrett Foster, one of the armed protesters, was openly carrying an AK-47. According to Perry, Foster motioned with his gun for Perry to lower his window. Perry fired after Foster began to raise the rifle toward Perry, defense lawyers said, consistent with what Perry told police officers after he turned himself in.

Several witnesses who testified during the trial said Foster was holding his rifle “almost parallel to the ground,” Clint Broden, a defense lawyer, said during the trial, KTBC-TV reported. Several witnesses said that Foster did not raise the rifle, the Austin American-Statesman reported.

Guillermo Gonzalez, one of the prosecutors, said in closing arguments that Perry maliciously drove into a crowd of protesters and that Foster “had every right to go up to him and see what the heck was going on and he had every right to do it with a deadly weapon.” Doug O’Connell, a lawyer representing Perry, said that his client “had no choice” but to shoot Foster because he was under threat.

Prosecutors said Perry had other options such as driving away and that he meant harm to the protesters, while the sergeant’s defense team pointed to expert analysis that found he was slowing down when he encountered the protesters, who had been moving around the city on the night in question...

From later in the article, "Austin police had found that the shooting was a case of self-defense but it went to trial after a grand jury brought an indictment based on evidence presented by prosecutors. A motion to dismiss was thrown out even though it included an affidavit from David Fugitt, a detective who said that Garza’s office forced him to alter his testimony. District Judge Cliff Brown said he didn’t see anything that rose to the level of egregious conduct."

Before too long, and it’s already late in the game, all remedies to this hogwash, and that of DA Bragg, must be on the table.

A concerted effort by our elites to make us feel helpless... Time to get some pressure on Governor Abbott... and the AG... My guess is the AG will make it an issue and Governor Abbott will have to vacate the sentence... I think forcing this to appeal would be a travesty...

Hard to imagine what law-abiding people need to resort to preserve their lives. No room for an individual to protect themselves. Wonder why it took the events at Bundy ranch to break the federal siege that took place there?

It was obviously self defense. So obvious, the police refused to bring a charge.

Then the political DA pushed for a prosecution and conviction.

A person who points an AK47 at you, as your car is blocked by "protesters" who are beating on it, is not your friend.

I admit, that’s confusing. The Governor has the power of pardon, not the AG. Now, it’s possible that Abbott wants a legal review of the case by the AG first.

Why do people assume that the law works the same way in every State? Governor Abbott does not have unlimited pardon power.

Article 4 Section 11: "In all criminal cases, except treason and impeachment, the Governor shall have power, after conviction, on the written signed recommendation and advice of the Board of Pardons and Paroles, or a majority thereof, to grant reprieves and commutations of punishment and pardons; and under such rules as the Legislature may prescribe, and upon the written recommendation and advice of a majority of the Board of Pardons and Paroles, he shall have the power to remit fines and forfeitures. The Governor shall have the power to grant one reprieve in any capital case for a period not to exceed thirty (30) days; and he shall have power to revoke conditional pardons. With the advice and consent of the Legislature, he may grant reprieves, commutations of punishment and pardons in cases of treason."

The Texas Governor can only pardon someone AFTER the Board of Pardon and Paroles recommends it.
