Three federal lawsuits against Illinois’ gun ban made some movement Monday as a federal judge ordered a response from the state to show “each and every item banned.”
In the Southern District of Illinois, four cases are pending. One is from the Federal Firearms Licensees of Illinois. Plaintiffs in that case filed a motion for preliminary injunction last week.
In three other cases, federal Judge Stephen McGlynn ordered state defendants to provide “illustrative examples of each and every item banned” under state law.
Thomas Maag, who brought the state level Crawford County case that was transferred to federal court, said the judge's order will make it difficult for the state to comply.
“Because the ban is so all encompassing and uses a great many vague terms that I’m not even sure that exactly what is banned and that’s probably why judge McGlynn ordered the state to do that so that we could find out what exactly we are arguing about,” Maag told The Center Square on Monday.
He said “the state has a tough row to hoe,” especially given recent U.S. Supreme Court precedent that cases regarding the Second Amendment must review text and tradition, not a balancing of state interest versus individual civil liberties.
“The plaintiffs in my case remain extremely confident that we’re going to succeed on the merits of this case,” Maag said. “This statute never should have been passed in the first place. And applying the Bruen analysis, we believe that the days of Illinois’ magazine and firearms ban are numbered and the number is not very large.”

It may well be overturned, but the commies that run IL have at least 50 more, with slightly different wording, in the hopper just waiting to be rubber stamped into law, so another years long legal battle will ensue while rights are infringed the whole time.
Rinse, repeat.
The have an entire states budget to finance it indefinitely.
I’m glad this is being challenged as strongly as it is.
Now I would like to see Pritzger get shot down like the enemy balloon he is!
Would that the judge imposed sanctions on the lawmakers for these insults to the rights of their constituents….

I’m happy to see this, and even happier that he said they have a “tough row to hoe”, instead of the “tough road to hoe” that you see so often, especially from the illiterate “journalists” we have to suffer with today.

When people think of a semi-automatic, they generally think of
the AK-47 or some such. Certainly rifles are on the minds
of the general public.
Actually, it’s any gun that can be fired again by just
pulling the trigger.
If the state wanted to, they could also claim a revolver
was a semi-automatic. You don’t have to cock it again, on
certain revolvers. (I forget the exact term for this.) There is one.
So this ban could reference all rifles, all semi-automatic
hands guns, and all revolvers, if the federal or state
ATF units wanted to push it.
That would leave very few guns in the hands of American
citizens. I guess bolt actions rifles and single shots.
Then there would be the pistols that only fire one shot
without cocking the weapon.
The Left just can’t help themselves. Deceit is the name
of the game.
They’re hoping and praying some idiot judge will allow them
to slip something like this through.
Sounds like this judge has their number.
If nothing else, he may be able to make an interpretation
that excludes some categories the Left wouldn’t.
Personally, I want to see a lot of gun rules rolled back.
None of the laws actually work.
These people are not up for a discussion of guns and rights. They just want us to have a discussion as to how we will be disarmed, or arrested or killed by the law enforcing or law breaking people.
