U.S. Supreme Court's Kagan blocks Jan. 6 panel from getting Arizona Republican's records

U.S. Supreme Court Justice Elena Kagan on Wednesday temporarily blocked the House of Representatives committee investigating last year's attack on the U.S. Capitol from obtaining Arizona Republican Party Chair Kelli Ward's phone records while the court further assesses the dispute.

Ward had asked the Supreme Court to intervene after lower courts declined to bar telephone carrier T-Mobile from complying with a subpoena from the Democratic-led committee seeking three months of her call records.

Kagan issued an order effectively putting the litigation on hold and preventing enforcement of the subpoena pending a further order by her or the full court. Kagan, a member of the Supreme Court's 6-3 liberal minority, is the justice designated to handle emergency appeals from a group of states including Arizona. Kagan's order directs the committee to respond to Ward's request by Friday.

What went wrong in her brain for her to do this? Normally this would be an automatic yes for a liberal. Something is wrong with her.

“ preventing enforcement of the subpoena pending a further order by her or the full court. ”

Key phrase “pending a further order by her”

Yeah, I think I know how this will go . . .

At some point the Justices will conclude that the Committee has zero intent of actually proposing any legislation as a result of these investigations. There will simply not be enough time between now and the end of the Congressional session for that to happen.

And the instant they so conclude, the fig leaf that the committee is pursuing a legitimate legislative purpose is ripped off, and the committee’s investigative powers should end.

Kagan has turned out to be about the best one could hope for in a Liberal judge.

Or trying to set a precedent to make it harder for republicans to turn the tables after the congress changes hands.

“Kagan has turned out to be about the best one could hope for in a Liberal judge.”

I believe she was involved in Obamacare working for Obama and therefore should have recused herself from SCOTUS obamacare cases.

Maybe the spirit of Scalia-past guided her.

Kelli Ward is the mastermind behind The New Republican Party in AZ.
Last time I checked, DC has no jurisdiction over Arizona.

Which actually is a good thing to consider… how this could be used against you (or for you) when the other side has power, as they most assuredly will at some point. Don’t take any power for yourself you don’t want the other side to have when they’re the ones in power, no matter how confident you are that your side will use it wisely. That’s why I was opposed to the Patriot Act from the beginning. And it’s a lesson the Democrats will learn when the Republicans take power. I’m thinking of the filibuster as I write this.

Just a guess, but sometimes, even liberal judges reach their breaking point of making their courtroom a mockery,

Now that republicans likely will take control of the House, this sort of chicanery by democrats for the last two years is suddenly just a big no-no. The judiciary is just a tool anymore.
