Klukowski: Speaker Kevin McCarthy Can Sue Joe Biden over Student Debt

If Republicans take over the U.S. House, they will have authority to empower Speaker Kevin McCarthy to sue President Joe Biden over his illegal transfer of student debt to non-college families, because the president has no power to “cancel” those debts.

The national uproar continues over Biden’s transferring hundreds of billions of dollars of debt from adults who attended college and still owe money, to taxpayers who either (1) never attended college, (2) saved money to pay for college, or (3) borrowed money to attend college but then honored their debt contract by paying off their loans.

That would take a just a tiny modicum of intestinal fortitude and what we call “balls” in these parts. McCarthy? Only “balls” he’s got were probably hanging out his mouth.

If it is an unconstitutional usurpation on Congress’s role, I don’t see why McCarthy—or other House members—would need to be the Speaker in order to initiate a case.

Maybe that has been a convention or even has precedent, but I’m not so sure why any voting House member couldn’t have standing.

Oh, please. If this move by Biden is ever implemented, it CANNOT be undone. Who's going to have the power to REINSTATE debts which have been cancelled? No court will allow it. And all Biden will get from this squishy GOP is a "strongly worded letter."

They could have sued to stop DACA, but they chose not to because they wanted amnesty any way they could get it.

I guess the answer is why have a Constitutionally named role called "Speaker of the House" if the House isn't supposed to appoint one person to speak on their behalf? Not that the Senate doesn't have a similar position, because the Senate does not represent the people, it represents the governments of the states (or used to).

The House is set up as a majority-ruled chamber. It would make sense that the Speaker speaks for the majority. If not, then any Democrat can bring a suit against a Republican President for any mischievous purpose.

That's why the Speaker must be the sole voice that speaks for the entire body.

Biden used the HEROES Act of 2003 to justify this. It states the Secretary of Education can modify (perhaps cancel?) student loan debt in times of “war or national emergency.”

It’s the same law Trump used to start the pause on student loan payments, and the pause on interest, which has been in place since 2020.

Secretary DeVos’ OGC prepared a memo arguing the HEROES Act didn’t support outright cancellation, but Secretary Cardona’s OGC just prepared a memo arguing the opposite.

Or any of those people that signed up, served the country to get their college paid for?

4 years of (in state) public college is 120k/year now (including room and board) so Biden’s loan forgiveness of $10-20k doesn’t mean the Marines with free college made the wrong decision.

Stunning at how some seem to think a college education costs 10 grand. Lol. I look at this as an interest free loan now. I don’t think interest should have been added to begin with for federal loans.

Interest on federal student loans is completely how the Affordable Care Act was funded and justified. The switch to 100% direct lending from the gov’t ijn 2010 was embedded INTO the ACA.

No interest on federal loans, no ObamaCare. . .

I read that Biden’s actions on student loans this week actually will cost $1 trillion (counting Trump’s pause in payments and interest since 2020 as well).
